    gun shop scam

    My daughter bought me a new S&W M&P shield 9mm. Went to a local gun shop and asked them if they could do the paperwork to transfer it to my name. Sure says they bring in the gun and $90 dollars for the paperwork. Seemed a tad outrageous so I went online to the Calif DOJ in Sacramento downloaded the single sheet of paper filled it out and enclosed the amount asked for, $19. Done deal.

    Some of these shops are nucking futs with the prices they charge. $81 bucks to send a single sheet of paper to Sac!!!

    Is it possible they did not know you're getting the gun from your own daughter?

    Because that complicates issues to where it's not just a simple form that you send in.

      If your daughter bought a gun for you that is the definition of a straw purchase and you should delete this thread now!

          Not if gun was purchased for you, or anyone other than herself, by your daughter...that is a straw purchase.

                Meh, when your daughter bought the gun there is a question on the form 'is this gun a gift' or something similar. If she would have put YES, which is clearly was, there would have been no problem. She could pay for it and you come fill out some paperwork. IIRC

                  Your daughter can give you a gift. You are doing a legal transfer afterwards.

                      Yeah, and you don't need a FFL to do that. Just download the form online and send a $19 check to Sacramento...

                        So the question is, did your daughter answer yes to the gift queston on the DROS and is a CA resident? If so, I agree this is within the law and my apologies.

                          It's only a straw purchase if she delivers it to her dad WITHOUT doing the PPT. If they do a PPT it is not a straw purchase.

                            Not necessarily true, say dad already bought a pistol in his 30 day limit, daughter then buys him a gun just so he can get 2 in 30 day limit. I would think that would be a straw purchase.

                              That statement is irrelevant as to what constitutes a straw purchase.

                              Another point of an actual straw purchase. Is that LE must prove PRIOR intent. There is nothing to say from a legal standpoint. That the lovely and thougthful daughter bought the gun for herself. Got home and realized she would like to gift it to her father.

                              Bingo, no provable prior intent element. Hence, no Straw Purchase.

                              OP, watch how you word things on an open internet forum that is known to be monitored by LE.
