Open Carry on SF BART today

So my wife rides BART daily to SF for work. She just sent me these pics asking if this was legal. She said that there was a gun in the holster but no magazine. I can't make out what is actually in the drop leg holster, however. Could be something other than a handgun and my wife just thought it was one.

I told her unless he was a LEO or Security Guard, that it was not legal.

But wanted to ask the more informed citizens here to confirm.
