No, not necessarily...

The usual first thing to do is contact the detective handling the case by phone, and ask what the procedure is to have the guns released...

Usually they will say they need official notification (paper records) from the court that the case is actually finished, and that there was an official dismissal of ALL charges...or some sort of adjudication.

Sometimes stories you get from a "a son's, in laws brother" is not always factual....

After the Police get official dismissal and adjudication, they can then release the guns back to their owner AFTER the owner applies to Calif DOJ, and obtains a LEGR with the gold seal...

Then that person can go to the Agency holding the guns, and obtain them...


One other issue with the OP chain of events... If charges had never been filed, the case would never had ended up in court...So charges were filed, and the DA went forward with prosecution, however once at court, some issue arose which precluded prosecution..

In some of these cases it would be the refusal of the alleged victim to testify or cooperate with the case...
