    Sold or not

    Hey guys I purchased an AR Pistol last week and I have a few days before it is done with the dros and I got a call telling me the upper was a mistake and that they can now only give me the lower for what I paid! This is a used gun, effectivly a private party transfer gun that has been in the hands of the FFL dealer doing the sale. It is the dealers private gun. I took a picture of it since it had lots of custome stuff on it as I bought it so I know what parts are there and what it is all worth.

    What should I do?

    The dealer is willing to refund and cancell the purchase but I want my gun man, and I bought it because it was a heck of a deal!

    He sold it so has to sell what came with it. If they messed up too bad.

      Sold as is. Document everything for the small claims judge.

        What shop and technically it's not his anymore once drosed. It can't go back to him unless you get denied or cancel sale at your request.

          Print your pictures out and have proof with date on pics if possible for court.

                No need to hurt the reputation of a gun shop as long as the owner makes good.

                I'm a small business owner so I get that when we mess up it hurts but that is the cost of doing Buisness. Sometimes I (as the owner) win, and sometimes I loose. As long as he makes good with providing what I bought then no need to share the name of the shop. On the other hand if he doesn't then yes I think it might be appropriate.

                So it sounds like your all confirming what I thought. Once the transaction was done and dros paper filled out the sale is finished. The fact that I have to wait 10 days doesn't change the status of the sale. Effectively that is my gun sitting in his shop. What I bought was a complete gun. He is trying to say at the price I paid (almost $1700 with tax) it would only cover his cost on the lower. Even if this is true...it isn't really my fault or problem. The approved purchase of this gun has also triggered a bunch of other purchases that if I cancel this gun (what he is asking me to do) I will be out a lot of extra money as I now have shipped in (purchased) several thousand rounds of 7.62 ammo I have no other gun to shoot that with. I have purchased all the other pieces I need like sites, backup sites, and other goodies... what a sad situation. Bummer man strikes.

                  $1700 for a lower by itself? Seriously? I want to know where I can get one of those gold plated lowers.

                  You've got a winner of a lawsuit OP if he reneges on the deal. The gun was yours once money exchanged hands and the DROS was done. If he holds part any part of it back you've got him by the short hairs with your pictures.

                        I would like to think the dealer wouldn't pull that... not t mention he told me to cancell the sale or offer him more for it! Man even as I type that it feels so shadey!

                            OP, the dealer is straight trying to rip you off. Hold them accountable, don't back down. Go get what you paid for after 10 days. If they won't give it to you as you bought it, then they have a legal problem, and it's time to take the gloves off. Nobody has time for that kind of BS.
