    Obtaining Off Roster Handguns

    Maybe someone more knowledgeable can answer this. I have a nephew in the Marines stationed at Camp Lejeune, NC. He is a resident of California and owns an off roster Glock that he purchased in NC. Can he return to California with it and sell it to me?

    If he gets pcs here or moves back here yes. If stationed there no.

      Yup, he needs to be a CA resident to transfer an off-roster HG to another CA resident under normal PPT.

      Intrafamilial does not apply between uncle/nephew.

        I was thinking he could transfer it to my dad and then my dad transfer it to me. Lol

          I may ask him to purchase the G30s I've been wanting and bring it to CA next month and have him leave it here until he gets transfered to Pendleton at a later time then we can do the PPT

            As you have presented the facts, your nephew would be committing a felony if he were to bring the weapon into California himself.

            Please refer to Penal Code section 27585 (and 27590(c)(5) for the felony penalty).

            If he ended his California residency (as defined by California law). then he could return to California with the weapon. So long as he remained on active duty, there would be no further action required. If he ended his military service, then he would be required to register the weapon within 60 days.

            Please refer to Penal Code section 27560.

            Please note that sections 27560 and 27585 apply very different law to the importation of a firearm based on the state residency of the importer. Also note that 27560 makes special provisions for folks on active duty while section 27585 does not.

                    I'm new to these forums and not too familiar with the laws on transferring firearms. That's why I posted here to get better expertise from people more familiar

                      where does your dad live? My dad lives in AZ and is coming to CA on friday and brining me a Glock 23 gen 4. He's going to drop it off at gun dealer where ill do family transfer :-)

                            I thought he was still a current CA resident. But he just told me his CA DL is no longer valid as he's been in NC for about 2 years or so

                              you're pretty much out of luck. Unless he moves back to CA and registers his weapon with DOJ. Than he could PPT it to you.
