transporting handgun in 5.11 soft case

    transporting handgun in 5.11 soft case

    Hi,

    I'm sure this has been posted before but can't find it.

    can I transport in the back of my SUV an unloaded handgun with unloaded mags in one of those 5.11 soft case ? Do I need to attach a small lock to it to meet the "locked" requirement ?
    how about in a backpack ?

    If that has a spot on it for a padlock you should be fine since its fully enclosed. You can always get a hard locking case at big5 for around $10.

      I will be transporting several handguns for a class so I'm trying to go "light"
      I can attach a lock to the zippers.

        Mags don't have to be unloaded either, even if in the same container.

          You can have ammo and the gun in the same container and it does not violate 12025, 12031 and the court ruled People vs Clark ruled that to be defined as loaded it has to be in a pistion to be fired. meaning if there is a round in the chamber its loaded or a loaded mag in the gun loaded. If there is a round/shell in the stock(say a shotgun saddle) then it is not loaded. It is also perfectly legal to have loaded mags. Also there is the open carry method, but there issues with school zones depending on location.

                I generally transport my pistol in a soft case with the main compartment locked with a padlock. Outer pockets have loaded magazines in them. This package rides behind the seat in my pick-up. If in a car, I put it in the trunk. Would this be considered legal transport? Would it be any different with a revolver and loose ammunition in an outer pocket?

                  Locking the case is all you need to do if there are no rounds in the gun. Loose ammunition or outer vs main compartments with loaded mags or semi-auto vs revolver matters not. You can put the locked case on your lap and it will be legal.

                    That's what I've heard from some and how I interpret the law to read. I've just heard of folks being rousted as well. I don't want any trouble and I do my best to follow the laws, but I don't go overboard either.

                    Now, how about rifles....do they need to be locked in the same conditions? Or are they OK open or in an unlocked case as long as nothing is chambered / loaded mag inserted? I know that the ones on "the list" should be treated same as handguns, but what about something normal like a Model '94 Winchester?

                      I believe rifles can ride shotgun with loaded mags on the dash.

                        Except for school zones, this is legal. An unloaded rifle or shotgun does not need to be locked, but for your sanity and to save you time if you are stopped by a LEO, it is a good idea if they are hidden from plain view.

                        Handguns need to be in a locked container, and the one you posted should satisfy the requirement, unless you encounter a LEO who is unfamiliar with the law and thinks the case has to be a hard case.
