      Currently an off-roster handgun can simply have a mag lock. In the future, yes, he would have to decide he'll need to reg as an AW or not, but that doesn't take effect until 1/1/2017.

      When did an off roster semi auto pistol with mag lock turn into an AW? None of them have yet.

              Why not? The POF and Omega mp5 style pistols, as well as the MPX, are perfectly legal to purchase with LE roster exemption, or via PPT in CA. It is not named as an assault weapon, and it can be made CA compliant.

                    You all need to untwist your panties, and read what I wrote originally. A, that he can not simply buy it as an off roster pistol as AW rules apply, and in order to purchase an AW he needs to have a letter signed by the department head authorizing the purchase.

                    Hey if I misunderstood the OP's reference to purchasing it as an off roster handgun my bad. But it does not change the fact that it has to comply with AW laws in existence now.

                    Having gone through H&K armorer school for MP5's and Trigger groups, and worked on both real (read select fire H&K's) MP5's and clones (Pakistani licensed builds), and I wouldn't want a clone if I could get one. Tolerance's are usually not the same making parts not as interchangeable as some of the clone builder's want you to believe they are, mags being the most noticeable in my experience.

An MP5, or a clone, with a fixed 10 round magazine, is perfectly legal to purchase and has nothing to do with any AW laws. It's no different than a cop buying a Gen4 glock, or an AR pistol with a fixed magazine.

                          What AW rules are you referring to? Can you find the PC that you're saying would be violated if this is treated as a standard off-roster handgun for LEO at this time (not post Jan 1, 2017). That is what I'm trying to clarify and understand.

                          If what you're saying is true (that it is already an AW) then no FFL without an AW license can sell any rifle that would be classified as an AW post 12/31/2016. If that's the case that is a problem and I read the new proposed law wrong. I thought it doesn't go into effect until 1/1/2017.
