Wait so now I have a question. Back in the 90's my uncle was arrested for exposing a firearm in public(not loaded), he was showing off a revolver to a friend on his front yard. He did not have any warrants and the gun was registered, was he wrongfully incarcerated?

The case is still up for grabs, his arraignment is tomorrow. He was cited with a misdemeanor through the mail which seems pretty sketchy. We'll see how it turns out though.

Yeah, that Theseus is sneaking around. I have seen him around on the board since he went "under the radar", but not much on the case. Hope we can hear something tomorrow...

Unfortunately I was in a hurry. I'm pretty sure that seeing a 6' 4" guy in red shirt and wearing a kilt would be an attention-getter, more so than open carrying any gun!

That would be a brandishing charge.

whatsoever, other than a firearm, in a rude, angry, or threatening
manner, or who in any manner, unlawfully uses a deadly weapon other
than a firearm in any fight or quarrel is guilty of a misdemeanor,
punishable by imprisonment in a county jail for not less than 30
days.

To brandish there should be the intent to use the firearm to intimidate someone. It isn't for just showing the firearm to someone.

............Particularly if you keep an empty magazine in the magwell as I do on the rare occasion I do. In this case, there is no way to argue that the magazine is an integral part of the weapon and that the weapon is merely incomplete.

+1. Why take the chance? Pandora's Box? Just seems really well....silly. How old are you guys that go to the mall to practice open carry (not being a dick, just really interested)

Open carry, unloaded. What does it accomplish? What is the point of carrying a pistol open unloaded? Educate me please.

As others have already stated, it helps reintroduce the public, and the law enforcement community, to the idea that normal people carry guns, not just cops and criminals. Also, I can unholster my sidearm, slam in a mag, and chamber a round in just a few seconds. I feel that's a whole lot better than no weapon at all, which is my only legal alternative.

Educate me please. I believe if you carry a loaded mag and the pistol near it would be considered carrying a loaded gun which is a violation of 12031 PC.

Let me quote myself here to answer this:

I've heard concealed magazines are illegal. Is that true?

While there is no code that supports this, there was an appellate case in 1974, People v. Hale, that ruled this way. It ruled that although the firearm in question was not concealed, the magazine was, and that only partial concealment is still concealment, and that the magazine was an "essential component" of the firearm. The logic is tortured beyond belief, but it's currently case law. One way to avoid this pitfall is to carry your magazines in belt holsters, so that they match the 12025(f) language of "carried openly in belt holsters". Another option would be to keep an unloaded magazine in the firearm, thereby "completing" the firearm, and invalidating the asinine "essential component" logic.

It is legal to OC a mag and gun right next each other, as long as it is not in a pistion to be fired(people vs clark, 12025,12031). You could OC a unloaded shotgun with shells on the stock. The benfet of carrying a long gun is that you could conceal the long gun as long as it is unloaded and you are not in a school zone.

I've read this before but never really gave it much thought until now. Very interesting... So does this really mean I can carry say a gsg-5 with collapsable stock on a 3 point sling under my jacket? or any other centerfire rifle at 30 inches? (unloaded of course but with the mag also conceled)
