    Gunbroker issue - Advice needed

    Advice please.

    I recently won an auction on Gunbroker and, after getting ignored by the seller for a few days when trying to arrange payment, I get a message from him saying he's sorry but the item sold already on another site. I won the item at a very low price and I am on the fence as to whether he actually screwed up or he is trying to back out due to the low sale price.

    Now I know he is in violation of the gunbroker site terms and it appears that he may still be legally responsible for following through with a replacement, even if he did already sell the original item, but I doubt that would be enforceable. I cold report him to gunbroker and nuke him on feedback, but that will likely nuke his account for the future and this could be a legit error on his part.

    Anyone dealt with something like this before? Any recommendations for how best to proceed?

    The GB rules allow for an item to be also available for sale elsewhere, it's usually at a brick and mortar dealer. However, the seller must note that in the auction, and if there is any bid on the auction, the seller must honor the GB bid over the other sale.

    Double-check the listing and the rules, and then nuke 'em as appropriate.

    The getting ignored part is what peeves me. Way back when, it used to be that both parties had three days to contact each other, but as technology progressed and everybody except me got a smartphone, they changed it to five days.

      The few days wait tells me he listed it on two or more sites and sold it to the guy who out bid you on the other site. Out him to GunBroker. Depending on his answer to you/them then consider negative feedback.

          It sounds like the seller is making zero attempt to set things right with you, so if the ad didn't say that the item is listed elsewhere and that they reserve the right to cancel the auction, I would nuke his feedback.
          Settle down, folks. The new "ghost gun" regulations probably don't do what you think they do.

            Yeah sounds like a douche that either didn't get what he was expecting without a reserve, or he found a higher paying buyer after the fact.

                    Yep, after sleeping on it and calming down a bit, I think that's what I'm going to do.

                    While I would be completely in the right to nuke his gunbroker account, I'm going to take the high road and give him the benefit of the doubt. A little good karma can't hurt.

                          Yes, like the previous post says, give him negitive feedback. You can also send Gunbroker a message and they could ban him from using gunbroker in the future.

                            Gunbroker only allows you to cancel the auction if no bids have been placed. Once a bid is placed the auction has to carry forth and the seller is obligated to sell - or risk getting banned by Gunbroker. The guy screwed you don't let him run free and screw the next guy too.
