Use the feedback system as intended: to give honest feedback on YOUR transaction. It gives others insight into the satisfaction of his buyers. You aren't nuking his account. His actions dictated your rating, which should be negative. I've sold quit a bit on GB and received a justly deserved negative rating for selling an accessory I sold on here and forgot to remove from GB. Oversight on my part and I plead my case to the buyer, but...I deserved what I got.sigpicComment

Well, I'm glad I gave this guy the benefit of the doubt.
He's now being 100% responsive and has provided a good apology and screen shots proving the item did sell on another site before I bid on it. It looks like it was his first auction and he did forget about it after the item sold. Now that he has realized exactly what he did and what his responsibilities are, he has offered to paypal me the extra money he made, over and above my winning bid.
Seems like a decent guy who didn't do his homework and then made a mistake he is now trying hard to make right. Glad I didn't nuke his account as I am confident he won't be making this mistake again.
I know, I know, "nice starry bra" . Anyway, thought it would be good to pass on how this turned out. Thanks for all the input guys.Comment

What he saidGunbroker only allows you to cancel the auction if no bids have been placed. Once a bid is placed the auction has to carry forth and the seller is obligated to sell - or risk getting banned by Gunbroker. The guy screwed you don't let him run free and screw the next guy too.Comment

He ignored me for two plus days, likely hoping I would go away. I didn't, and I sent several messages during the period. Then last night he sent me a two sentence e-mail saying thanks anyway, but it's already sold. That's when I got pissed and created this thread looking for advice.
He has since sent several longer follow-up e-mails explaining what happened and trying to make things right. I believe he researched the site terms, realized he made a bid mistake, and that changed his attitude. If I still thought he had done it on purpose I would leave negative feedback. A short time ago though, I received a paypal payment for the difference between my auction price and what he sold the item for, so he clearly wants to make things right. I'm good with that and consider the situation resolved.Comment

Certainly sounds like moronity rather than malfeasance, but that's kind of a bizarre way to resolve it. He owes you the thingie, not a token couple bucks to get yourself lunch.
I gotta agree with most other posters, leave honest feedback, it shouldn't be vicious, just report it so that other auction users can see his record. Otherwise, the whole system collapses!I meant, it is my opinion that...

Wow, what a clusterf*ck. If he was a newbie individual seller, it was too bad for both of you. Looks like he tried to make it right and you are a good man for not leaving a negative feedback. If he had been a dealer, then I would've insisted he finds you the same item and sells it to you at the price.
GB usually discloses a phone number of the seller to the auction winner. Didn't they do that to you?sigpic
