Yeah good luck with that. Off setting penalties maybe, you committing a wobbler and him a misdemeanor. Since you threatened to kick his azz, and he responded. Somehow I think the guy with the CCW should have been the bigger person and de-escalated the situation. I mean after all don't they stress avoidance in CCW classes.No jumping, barking or anything other than trying to get closer to him, which I restained to my heel. I think if I would have had my pepper spray I would have sprayed him as he aggressively pointed it at me zapping it. If I knew who he was or where he lived I would report him as he did brandish a weapon.Comment

If you had pepper spray you would have sprayed the jogger? With that frame of mind it's only a matter of time before you get your CCW revoked if you end up in a scuffle which YOU instigated, or worse... I think you'll find you'd have a very difficult time in court with that one.

Wow you guys are coming down kind of hard on OP. Obviously reporting it is the right thing to do as mentioned above.
But I gotta admit, If someone pointed pepper spray at my dog - for no reason, I'd be livid. Ultimately I'd probably hurl an insult and be done with it. But lots of scenarios would take place in my head...

If it comes down to a he said/she said, op would need to admit to the officer that he threatened the other person for them to be able to do anything. Op could easily just say the other guy drew his weapon and he ran off only saying "stay away from me." If the other guy admits he drew his weapon prior to a threat, it would then be his fault.

Report or ignore, two choices.
Use of pepper spray on him would have been hilarious, but then you could get dragged into more drama if he reports his version of the story where he states you allowed your dog to be aggressive with him, then pepper sprayed him when he was just preparing to defend himself from your dog. Good chance you lose without video.Comment

Without knowing 100% of the details (whats was going thru the joggers mind, if he was high on something, if he was attacked in the past by a canine...etc)
Safe to say the jogger over reacted and if he was really fearful, should of distanced himself from OP and his dog....
Oh and OP, wheres the pic of the said offending dog? How are we suppose to know what kind of killing machine you have?

Maybe the jogger had been threatened by dog-walkers or their dogs before. You know, constantly being barked at.
Then one time, some guy threatened to "kick his @**" in the past, as he ran by.
Then he also noticed the dog-walker looked like he might have a pistol tucked in his waistband, so he picked up some pepper spray and runs with it now.
Maybe that's what his state of mind was, though I know you certainly have the perfectly trained dog, and your CCW piece never, ever, prints.Comment

I think it's a bad idea to post a picture, seeing as how OP posted that he was considering use of force and admits to threatening the guy, even though he was threatened first. The dog could be identified. This is a public forum after all. I've dealt with the same problem as op having a pit bull rescue. Most people run away without even giving him a chance, because they are dumb. Now I don't take him for a walk without my pistol, because I see it as inevitable someone will do something really dumb. OP's best bet is to remember who that jogger was, and just be wary of him in the future. If you're really worried about it and you want proof that he is threatening you, buy a body cam or go pro. I know... You're right. Just that someone pointing a weapon at my dog, without provocation, kind of upsets me. Obviously being a CCW holder means you have to have a lot more restraint. It's understandable. If you're like me, your dog is part of your family. I'd protect my dog same as my children. I'm not sure if showing restraint applies here though, since if we believe op, the other guy already had a weapon drawn on him. At the end of the day though, we can't know for sure. I think the most important thing for people to take away from this is to always be cautious of those around you, and avoid trouble if possible.I know... You're right. Pointing a pepper spray at a dog has to be restrained, but is still trying "to get closer to" you could be a reasonable thing to do.

I have encountered many dogs whose owner's could only hold their dog back with great effort and/or could merely slow their dog's continuing forward progress.
Also, we are talking about a dog here, not a person. Dog owners expect us to treat their dogs like their children, which they are not.
The dog in question had to be restrained, as he was not healing on his own.
There was the very reason the jogger prepared his pepper spray.
Clearly the dog's training and discipline was ineffective as passersby felt unsafe.
Also the actual size and breed of the dog in question is not stated. This plays greatly into the equation.
Finally, what kind of CCW'er thinks that an insult is an appropriate way to deescalate a potential firearm brandish/use?
As a LTC holder we are held to a higher standard.
A firearm use or display in the circumstances described could have cost the OP his CCW permit.
I am not sure that I could make a case against such a decision...Real Californian...Comment
