      How this is going to pan out? Are you kidding? Someone broke into their home and attached them, and got shot as a result. This is completely in line with California's Castle Doctrine, and the no duty to retreat doctrine. Clean shoot.

        The perp will still sue and their homeowners insurancce will pay the policy limit rather than fight it. That happened to a friend of my wifes and they were adiment about not paying the dead scums mom & dad a dime. They hadn't seen/heard from him in 3 years but still ended up with $300,000. Guess they earned it for the stellar job they did raising the little darling.

              Criminals are generally not protected by insurance policies like this. There are some rare cases, but the law mostly won't have it. Usually it has to do with some act of misfortune. I.E.- a criminal falls off the roof due to old roof tiles while trying to sneak in through the chimney. Another one- a drunk person stumbles over a neglected pavement tile into a vehicle obeying all traffic laws and gets severely injured.

              Unfortunately the tax payers are the ones who end up footing the bill for these dip****s, not the insurance companies (who shouldn't have to pay either).

                Why don't the victims get to counter sue the perps parents for the ****ty job they did.

                    He who breaks into someone's house deserves to be shot. I am no lawyer, but the details can be worked out later on. Glad the home owners shot him and considering he broke in and was struggling/attacking one of the occupants, I hope they call it a good shoot and call it the day.

                      There is an admin on the boards here that was involved in a shooting incident where the bad guy was going to kill him and his coworkers. Mr. Admin defended himself and his coworkers with his firearm, stopping the attack, and still got sued even though it was a righteous defense of life.

                      If a person (especially in this state) gets into a shooting or other use of force incident, expect to be sued from either the dirtbag, his family, or his estate, no matter how "right" the incident was.

                        The writer insists on calling the perp a "burglar" when he is a robber. Burglars pilfer from houses, robbers use force to steal from people. This guy broke into an occupied home and went hands-on with the occupants. Armed occupants, luckily.

                          This is why you have a monitored burglar alarm and ALWAYS set it while you are home (unless you're going in and out frequently, like when gardening).

                            MARINA, Calif. —A would-be burglar was shot by a resident in the Fort Ord military neighborhood in Marina, Presidio of Monterey police said.
                            The incident happened around noon on Wednesday when a teenager tried to forcibly enter a home on Kalborn Road in the Marshall Park section of the neighborhood.
                            Two men were at home when the 18-year-old tried to break in.
                            "A physical altercation ensued with one of the males, the second male in the residence retrieved a pistol, a firearm. There was a struggle shortly after that for the firearm, at which time two shots were fired," said Shawn Marshal, director of emergency services for the Presidio of Monterey.

                            One of those shots hit the teen. Presidio police responded within minutes and the would-be burglar was transferred to Natividad Medical Center in Salinas.

                            He was listed in critical condition.

                            Both of the men who live in the home are civilians. One is a veteran.

                            The teen was from out of town and was visiting relatives in the neighborhood this weekend.

                              They were renters. That area is all renters. No homeowners ins.
