The act of simply owning one is a felony? No in or attached to the gun, but just owning it?
Please cite the PC.
Idiots like this just strengthen my argument that if people think the 2nd is out dated and only applies to weapons to be had when the Constitution was ratified, the the 1st only covers free speech and the freedom of the press in the forms they existed in when the constitution was ratified. No TV, Radio, Telegraph or the Interwebs.Last edited by baggss; 12-24-2015, 12:47 AM.Comment

I don't think the two sentences of his were meant to go togeather like that. The act of simply owning one is a felony? No in or attached to the gun, but just owning it?

So I just researched this again, and it is not a felony --- you can possess a magmagnet as long as it is not attatched to the bullet button permanantly. As long as the intent of the magmanet is to be only used as a "tool" to remove magazines like you would the tip of a round or a gerber as opposed to turning the bullet button into a full-time magazine release.
Let's not ruin something good, please.Comment

Not correct. According to the CalDOJ the tool cannot be ATTACHED to the rifle. It must be separate. The magmagnet is only legal to use outside of CA.
In Ca, as soon as that magnet attaches to the bullet button you have now created an assault weapon and committed a felony. The law has nothing to do with whether or not something is attached permanently.
You will never see a vendor use or demonstrate a magmagnet in CA on a full rifle. Why is that? Because they can't! They only demo on a lower because at that point it isn't a centerfire rifle.
Once again, the ONLY legal reason to buy a magmagnet is to use it out of state. If you're going to do that, just take the 2 minutes to swap the bullet button for a regular mag release once you're out of state. Don't be the guy that gets arrested for something so dumb.If you are wondering if you can get a LTC in Riverside County: THE ANSWER IS YES!

Again, DOJ has not approved nor disapproved of the magmagnet and it can be used AS LONG AS IT IS NOT ATTATCHED with the intention of making the bullet button a full mag release. Look at the video below and see how he puts it in the bullet button just to release it. He then takes it out. That is what I meant by intentionally using it as a tool. Not using it to make it a regular mag release. I've also been using this for years with my AR. I'd like to believe that out of all the prior service and CA LEOs at the range I've shown this to, they would have said something against this claim. When I'm not using it, I just put it on my forward release and let it stick there.
Also, if this was be a felony, the makers of magmagnet would be out of business and the DOJ would have said something by now. This has been out for years.
Your claim of just having it in this state (if that is what your implying it) which makes it a felony is a no-go. You can have and possess it and use it in CA. Godspeed my friend.Last edited by WestttyWest; 12-24-2015, 2:55 AM.Comment

My claim is not that possession is illegal. Using it in CA is illegal. I've asked 2 well-respected 2A attorneys and both have confirmed that this is not a tool and is illegal to use with a bullet button. Look up the actual law, intent has nothing to do with it. The tool cannot be attached to the rifle while it's being used.
Also, just because the company sells it doesn't mean it's legal to use. Tannerite gets sold every day and is illegal to use in CA. I would challenge you to call or email the magmagnet company directly and ask them if they will help to fund your legal defense if you get arrested for using their product. If they really believed it was legal they would say so. Instead they will hem and haw and tell you now to use it on a centerfire rifle in CA.If you are wondering if you can get a LTC in Riverside County: THE ANSWER IS YES!

Here is the FAQ from the companies website. Notice is says that it's legal for everything EXCEPT for a centerfire bullet-buttoned rifle. Weird how they left out saying that it's legal to use.

Unfortunately, its not for your 2A lawyer friends to decide, its for the CA DOJ to decide. And they don't have an official word on it.
I'd love to hear what your lawyer friends say in their hermeneutics of specific regs and laws that make their opinion, though.

You'll have to forgive me if I decide to take the legal advice of actual attorneys when it comes to the law. Especially considering the work they do with the NRA and are a leading law firm specializing in firearms laws. Consulting attorneys that will actually represent you if you're arrested is usually preferable to talking with salesman, gun store clerks or patrol cops who don't need to be legal experts.
We've been talking about the magmagnet here on Calguns for almost 6 years. You've been here less than a month. Bill Wiese is one of the original founders of Calguns Foundation who helped make bullet button and off-list lowers legal.
Here's the link:
Also, you're wrong about CalDOJ being the one to decide. They specifically have said that they will not comment on the legality or illegality of various accessories. It is ultimately up to the officer that arrests you, the DA that charges you, and the jury that will either acquit or convict you.
Ultimately, if you decide to take the risk of continuing to use it, it's totally up to you. Whether or not you get arrested, convicted and lose your 2A rights has no impact on MY life. But for other people reading this I want them to read that it's illegal. If anything else it's very firmly in the dark, dark-grey portion of the legal spectrum.
If you enjoy shooting, it's not worth using this tool to jeopardize your 2A rights and a potential felony. Just use a different tool, it's not that hard to find something that works and isn't so risky.Last edited by Sleighter; 12-24-2015, 3:22 AM.If you are wondering if you can get a LTC in Riverside County: THE ANSWER IS YES!

So far to our knowledge, has anyone been convicted of a felony over the Mag Magnet?Comment
-
Yes, when I used to work at a gun shop, 2 detectives came in to talk to us because one of the guys they arrested in some sort of raid had mag magnets on his guns, and told the cops that we told him they were legal.
Our shop never sold them, and actually still has a huge sign on the wall about how they are illegalOriginally posted by KestryllThis guy is a complete and total idiot.

Bullet buttons are unsafe. There is no denying that.
Not being able to readily remove the magazine to inspect that the weapon is clear before handling, during a failure to feed, jam and failure to fire are all huge safety issues.
When my son was 9-years old he was able to deduce on his own without any coaxing that laws will not stop bad people. His example was from him observing that the speed limit was a law, it was posted on the side of the road for everyone to see and obey, yet, folks disregarded it and sped anyways, thus breaking the law. People willing break laws all the time.
If anyone had intent to shoot as many people as they could and had even a basic understanding of firearms, they would remove the bullet button and use high capacity magazines. My biggest concern is that the media focuses on the guns. Murder is illegal. It doesn't matter how you do it.
While I am ranting, on to CCW won't help anything. I agree, one person that has a CCW during such an event, likely wont be able to stop the threat. However, if 30% of the intended victims had a CCW, the threat would be eliminated in short order. Let's think about it people. Is the S.W.A.T. team one person? Does one LEO show up at the scene of an active shooter and that is the end of it? NO!
