    DOJ APPS agents seize 500+ guns from Clovis resident

    Name is Albert Sheakalee. He has no criminal history. He may have been put on a 5150 recently...



    California Department of Justice agents have seized more than 500 firearms from a Clovis man who is prohibited from owning guns, Attorney General Kamala D. Harris announced Wednesday.

    Sheakalee is in an Armed & Prohibited Persons System (APPS) database due to a prior mental health hold, which prohibits an individual from possessing firearms, authorities said.

    The biggest weapons seizure ever made in a single home by the California Department of Justice, and it happened in Clovis -- more than 500 firearms and 100,000 rounds of ammunition.

            They've stolen an individual's entire investment and life's savings. This is insane, 59 years of committing no crime and suddenly he's dangerous? If he's dangerous, why is he not locked up?

              Agents say Sheakalee was once a federal arms dealer, but he lost his license last year. And this year, he lost his right to own any firearms after he was institutionalized three times in June. "Obviously when a person is admitted into a hospital for a mental health hold it's because he's believed to be a danger to himself or to the public," Haroldsen said.

              In this case, they say Sheakalee still had about 150 registered in his name five months after he was ordered to give them up.
              If accurate - and might be, since it seems he did start getting rid of some - the application of existing law really isn't that controversial (the existence of the WIC 5150 law might be).

                Does he have a lawsuit since the state released information about his mental health status? If so I hope he sues their pants off.

                  Something doesn't seem right about this.

                  Of course, we don't know the details, but being 'admitted' to a hospital is not the same as being 'committed' to a hospital.
                  Just taking up space in (what is no longer) the second-worst small town in California.

                      Not really seeing the problem here. The guy was placed on a "mental hold" against his will by either police or medical professionals, therefore, he is a PROHIBITED" person, period. What's the beef?? You really want crazy people to have firearms???

                        Just what would he sue the state for?

                        They've reported his arrest for a crime which has a mental health predicate. The state can do that.

                        If you're thinking that HIPAA precludes the state from reporting his arrest, please check out the definition of "Health Care Provider" contained within HIPAA. The State DOJ is not a "Health Care Provider" and is not governed by HIPAA.

                            I agree we are missing a lot of information. But I have to say it doesn't look good for him. The one article said he was admitted three times on a "mental hold", to me that infers at least 5150. He may have gone voluntarily, and got 5150'd if he didn't agree to treatment. Either way, he's SOL for guns.

                            Then again, we just don't know. But DOJ must had some kind of paperwork. I'm sure they didn't just pick him at random.
