    The gun show loop hole topic

    The gun show "loop hole" topic will come up in when the dem vs gop debate happens. Dems have been talking about "common sense" gun control with the "loop hole" as a main talking point. Curious as to what you think a gop rebuttal would be on this particular topic.

    I've done my best to research gop candidates rebuttals to dem gun control policies and while I've found plenty of info about them supporting 2a rights I have yet to find a gop candidate speak in favor or against the loop hole topic. Please point me to it if you know of a resource.

    Seems to me just being in favor of 2a rights isn't enough in a debate if they are going to talk about this specific gun control topic. Nobody wants crazy people and felons to obtain firearms. If a gop candidate is asked about the loop hole topic they are going to have to explain why they wouldn't support legislation to prevent these people obtaining guns in this way.

    Not trying to troll the forum. I just know when the election debate gets down to dem vs gop they tend to start to pander to both sides.

        Some states like AZ don't have a requirement for all firearms sales to go thru an FFL like CA does.

        When I lived in AZ, I bought and sold guns all the time.

            I believe that in most states you could go to a gun show, buy a gun and leave with it, no waiting period and I'm not sure if a background check gets done or not.
            I'd agree with you but then we'd both be wrong...

              Yeah, NICS checks can still be done from dealers. For private party sales they aren't necessary, and don't need to take place at a gun show.

              For example, you could go to a gun show with a rifle over your shoulder and a pricetag hanging off of it, and then just sell it to whoever says they'll take it. They hand you cash, you hand them a rifle, part ways. But that has nothing to do with a gun show, as you could do the same thing via and online ad(like a marketplace forum, or even craigslist assuming it doesn't get flagged), go meet in a 7-11 parking lot or whatever and do the transaction there.

              Basically, it's the "gun show loophole" because they don't like gunshows, and want every state in the US to have a crappy PPT requirement like CA. It's also not a "loophole", since it's simply one person selling private property to another. They want to call it a "loophole" to scare people into thinking that the law is being subverted or whatever, when it clearly isn't.

                As already stated, there is no gun show loophole in California. Sales at gun shows are the same as any firearm transaction in California. What the topic is that in some states you can sell used guns face to face without any restrictions, just like we used to do in California before the nanny state stepped in and made buying firearms a costly waste of time.

                  I figured most people would understand the topic if I simply used the "loop hole" term that the dems have coined it. I stand corrected. I'm actually surprised that even after others have explained what it is in detail and that it isn't possible to purchase a gun his way in California that nobody has chimed in as to what a gop candidate would say in a debate on this topic.

                    What the GOP should say (but won't) is that the private sale of privately owned firearms between residents of the same state is not interstate commerce and hence is not within the power of the federal government to regulate.

                      In some states person to person transfer is legal. For residents. There is this concept called "states rights"

                      Dealers must fill out the federal form.

                      Not every state in the union is ruled by Bolshies.

                      This is America- its no ones GD biz. what you own.

                      Its common sense to realize that making it law that the state knows everything that you own is Un- American and goes against the Constitution.

                      That's the fooking answer.

                        Also, simply pointing out that there is no loop hole would be a good way to go. A lot of talking from the Dems about something that doesn't even exist.

                          Closing the "loop hole" would basically mean registration thru a side avenue. This gets folks who know their history a little shaky in that registration can become a step towards more restrictions and/or bans which over time might become confiscations.


                          Glad to see it took so many post before me to get the point across. Damn CalGuns, you slippin.

                            OK, that's what I thought -- no loophole in CA.

                            I did employ the CA C&R "loophole" while I could. That's gone now, of course -- but I checked off many of the C&Rs on my wish list before that happened.
