maybe he thought it was ok to answer 'yes' since he had a prescription


with HIPPA laws i doubt the DOJ would have that type of access to your buddies RX or the MJ card

37 states have operational programs that record any prescription you are given by a doctor. That would, I guess, include one for pot.

Did anyone really think that nobody except you, your doctor, and you pharmacist were the only ones who knew what you were prescribed?

In California at least it is not reported since it is a recommendation and not a prescription. You run into problems getting firearms if you get the optional state issued medical marijuana ID card.

I have a colleague that I work with and he was a mmj card holder and when his card expired 9 years ago he stopped using. When he bought his handgun in 2014 he was approved. I would have thought those kind of records would stay on his background for life. Go figure...

He probably didn't get the state card. It's supposed to be anonymous but the state cross references it with the APPS.

I've advised him to submit for live scan. So I'm waiting on his results to get down to the source of his denial. Just wondering if that's all the info he needs to reveal the true issue?

May be related to the positive test while a truck driver. From what I can find if you're driving when it occurs it stays on your DAC record permanently, even after you get counseling and cleared to return to driving.

I'm guessing he said yes to weed on the 4473 even though he now says he answered no, just so he doesn't sound like a complete moron.

Just to clarify if anyone answers the 4473 questions "wrong" thee DROS doesn't even need to be processed. The sale is denied right there because it can't be completed based on federal law.

If the dealer proceeded to process the DROS after the customer answered "Y" to anything but "is this gun for you" (and potentially the alien question) then they wasted $25 and didn't answer the 4 Yes/No questions on the DROS form properly.

Nine years ago he got popped for marijuana and he is still using it now. Maybe the Feds consider nine years of use and attendance at a drug class that didn't work, as proof of addiction.

Just because you have a marijuana referral does NOT mean you've consumed marijuana. I get prescriptions all the time I never fill. Seems to me law enforcement would have to prove you've actually consumed it.
