Hi, I was hoping to get a clear answer regarding my mmj card status. In august 2014 I was issued a mmj card and used mj up until october. I have been clean since then but my card is good until august of this yr. By no means am I addicted to mj but legally am I unable to buy a firearm.

Yes, possession and use of a schedule 1 drug is illegal federally. Admitting to crimes here is probably not the best course of action for OP.

As far as owning a gun, best thing to do is probably wait, but IANAL.

Question #11 (e) of Federal ATF form 4473 asks.

Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance?

According to FEDERAL LAW, your Ca. Doctor issued Medical Marijuana Card is just so much toilet paper.

If you use marajuana you are, according to FEDERAL law, not permitted to buy a firearm.

If you use marijuana and answer [NO] to the question, you also commited fraud.

The Obama administration has told the US DOJ to pretty much back off marijuana except in extreme grower/smuggling cases. But will the ATF follow the Messiah's directive? I would not want to be a test case. Because it is still illegal according to written law.

Because I possess a medical marijuana card but I have not used cannabis since october of 2014 and do not plan on using it any longer but my card is active until august of 2015

so if the medical card means nothing and I do not use or possess mj by answering no on form I am not commiting fraud and i should be legal to own a firearm.
