As long as the serial number matches your paperwork, you are good to go. The issue of 5-shot vs. 8-shot is none of the DOJ's or ATF's concern. They only care about a legal transaction and matching serial numbers.

Whoever sold the gun should of opened the box and matched the paperwork. I doubt they would know the difference between 5-shot & 8-shot.

Well, numbers match on paper work and shotgun. I also looked at the paperwork, it does not specify whether it is a six shot on a eight shot on my order. It is all pretty legit purchase as there is no difference in the numbers on the gun and those on my yellow receipt.

You're fine as long as the serial number matches the paperwork. No issues.

It could be that they didn't have the one the op ordered due to the fact that they are closing that line, didn't want to lose a sale and gave him the sale price. As long as the numbers match, there is no problem.

The only problem I have is picking up the gun and not looking in the box.
I bought a rifle at Dick's, they put it in the back for 10 days, the day I picked it up, he gets it from the back still in the box, puts it on the counter and says, sign here. I asked him if he was going to check the serial number on the receipt and gun to make sure they match, he said no. I said, I will and then I will sign it if the numbers match. He then signed the receipt, his copy and I asked him why he had to sign it, he didn't know, I told him it is because you are verifying the numbers match.
He said oh, do they match? I said, do your job and check it, you do know we are both on camera? He did and thanked me for being patient with him.

Ordered a new Maverick 88 five shot at Big5 two weeks ago for $199.00. Basic five shot model. Arrives yesterday and I go to get it. Clerk takes down serial numbers and paperwork and does not open the box to look at it at all. When I get home, I take it out to look at it and it is the 8 shot model for $90.00 bucks more!!!!!!!! Epic........

The 8 shot is $90 more? Isn't that getting into Mossberg money?

Being the curious type I checked Big 5 website and searched Maverick 88 all they show is the 8 shot, when I did just Maverick I get the O/U & the 8 shot model 88, perhaps they are just out of any pumps except the 8 shot.

So I broke down and called the store and told them what was up. They told me that they now only carried the 8 shot model and that the 5 shot was discontinued. The Maverick is being phased out in favor of the Chinese models. I got lucky here!!!
