what's the legality of a benelli m4 super 90? Is there anything against a pistol grip on a semi auto. This one in question has the pistol grip rifle stock, rifle sites, extended mag tube, and what they call a "Breaching device" at the end of the Barrel, it is stamped HK and Benelli both. Was there ever a time a shot gun like this would have had to been registered as an AW? Thanks in advance.

Oh I see. A guy from work has one, and he was saying he thought he registered that one as a AW, I have seen it , and it has the standard rifle stock. But if he did infact register it then Its a no go for sale. unless out of state. He's interested in selling but was worried about The AW thing.Comment

12276.1. (a) Notwithstanding Section 12276, "assault weapon" shall also mean any of the following:
(6) A semiautomatic shotgun that has both of the following:
(A) A folding or telescoping stock.
(B) A pistol grip that protrudes conspicuously beneath the action of the weapon, thumbhole stock, or vertical handgrip.
(7) A semiautomatic shotgun that has the ability to accept a detachable magazine.
(8) Any shotgun with a revolving cylinder.
You cannot have both (A) and (B) above (ETA: unless a registered AW, but I'm not sure if the M4 was even available before Jan. 1, 2000 when AW registration ended).Last edited by peepshowal; 11-19-2008, 8:41 PM.Comment

I could have sworn I was just in a shop that had these. Is the M4 super 90 the model that can do both semi auto and transition to pump? If so, that's what I was holding on to and it was definitley new. They actually had 2 and also the Supernova Tactical in desert camo, which was very sweet.Comment

This is the one I'm thinking of. The Benelli M1, M3 with a folding stock. It was both a pump and semi-auto. To use that factory stock, you would have had to register it back before 2000 as an assault weapon. Both a pistol grip and folding stock is an AW feature.

Unless the stock folds or collapses it is not an AW and would not have required registration.
The breaching device is just a muzzle brake like attachment that keeps the barrel off the surface of whatever youre trying to shoot through.
If it was registered as an AW then he needs to unregister it before he can sell it to you.
The state would have mailed him paperwork when he registered it, he can always contact the DOJ to check what he has registered in his name.
As currently configured the shotgun should not be considered an AW.Comment

I was actually answering this part of the question and had the HK Benelli M1 and M3 in mind. Yes, you're right. The newer version of the Benelli could not have been registered before 2000.Was there ever a time a shot gun like this would have had to been registered as an AW? Thanks in advance.sigpic

I bought a new M1S90 in 1997 and it's a Benelli USA marked gun as would be any new Benelli sold today.
My 1993 vintage M1S90 is an HK marked Benelli.
Benelli was imported by HK up through about 1996 or so.
ANY HK Benelli is a pre-2000 gun.Randall Rausch
