Correct me if I'm wrong, but my 18" Mossberg 500 has 8 shots and the magazine tube doesn't extend beyond the barrel. I don't really understand the compactness argument. It'd make more sense for me if that allowed you to have a 12 or 14" barrel, but it doesn't.

As for 5 versus 8 shots, I suppose it may not matter as a practical real world matter. But let me ask you: if you hear people breaking in, and you scramble to find a weapon. Two shotguns are there. Identical, except for the amount of rounds each holds. 5 shot and 8 shot. Which one are you going to grab? 5 shot and hope you can manage to do tactical reloads, or 8 shots?

I like my 12GA Winchester 1300 Defender with the factory 8 shot magazine tube...

The Defender was the first shotgun I ever bought and I still enjoy it.

The HD shotguns with the extended 10 rd magazines and long barrels are great for people that like the way they look and have no plans to actually use them for anything. Add on a RDS and a 50 shell bandolier and you are good to go. Or actually, you aren't.

If you can't stop a home invader in 5 shots, I doubt very seriously that 6, 7, 8 or more rounds are going to make much of a difference anyway.

1. Please cite a case where a shorter but still otherwise normally legal non NFA shotgun has been an issue.

2. A round in their general direction? Warning shots? So... you're shooting in the general direction of people without actually fearing for you life. If you were actually fearing for your life, wouldn't it make sense to actually try and I dunno... hit the person?
