    Question about the BX-25

    I've done my fair bit of research and googling/searching this forum for the answer to this question but it doesn't seem like it's been answered.

    I am interested in acquiring a BX-25 magazine, and my question is, would it be illegal for me to physically buy it at say, Cabela in Nevada, and bring it back in, or maybe purchase this item online in its assembled form assuming they are willing to sell that to me? Or will this be considered "importing"/causing manufacture of the magazine?

    This is section 12020 of the penal code item a)2), which states:

    (a)Any person in this state who does any of the following is punishable by imprisonment in a county jail not exceeding one year or in the state prison: - See more at: http://codes.lp.findlaw.com/cacode/P....R7IckVuq.dpuf

    1. Not illegal to purchase in Nevada.
    2. Illegal to bring it back assembled.
    3. Not illegal to purchase online.
    4. Illegal to have it shipped to you assembled.

      Could you explain to me how it can be that 1 and 3 are not illegal yet 2 and 4 are illegal with the penal code please? Thank you.

        Illegal to assemble in CA and probably soon to be illegal to own unassembled parts kits.

          Yes, I realize it's illegal to assemble them in CA, but what if they come to me already assembled?

            1 and 3 have NOTHING to do with California. You only need to follow CA law inside it's boarders. So, you can not legally import it or manufacture it once the parts are in the state.

                What if you are part of the illegal importation chain? Well, then you are a criminal who is engaging in a crime. How hard is that to understand?

                  Okay, thank you for that. I was just unsure to the extent of the word they are using "import" because I thought the definition entails selling the magazines, too.

                  Well, I understand it now better if they meant import solely as the act of carrying the object into state lines. Thanks again.

                  On a side note, small things like this really contribute to my eagerness to move out of CA eventually.

                    Since the BX-25 didn't exist in 1998, i have to imagine it would be pretty tough to explain to a judge how you have one without either importing or assembling illegally. Take the 5th amendment and shut up i guess.

                    I suppose you can always say you found it.

                      Hmmm, that's true. I just figured it wouldn't be a problem if I could get ahold of one since the law explicitly states it is not illegal to possess one for personal use.

                      In any case, I think for now I'll just go with an Alangator Trimag and just connect three 10rd mags together. :|

                        You can always rebuild your old mags with new parts. But, I prefer TI's 25 round 10-22 mags to Ruger's so, I'll probably never have any want or desire for some BX-25s.

                          Here's the deal, if you are going to shoot on a private gun club, I wouldn't get overly worried. I would not use one in public, or else you risk a felony, and who wants to deal with that? Whether it comes to you dis-assembled or not, it will be assembled when you load it and use it. That is a felony in CA, because they are not grandfathered in.

                            Yeah, I think I'll stick with devices that attaches the two 10-rd default magazines together, for now.

                              So if you "found one" at a gun range assembled it would be legal because you neither assembled nor imported?
