My point is that a prosecutor has to prove that your intent was to violate the law. The law that could possibly be violated deals with making a supressor. If your intent is not to supress your rifle, and if you are not making a supressor, you cannot be convicted of the crime. Mens rea is a requirement in EVERY criminal charge. You cannot be convicted of a crime unless your intent was criminal.

Most people don't know this. And the more we curb lawful behavior because we fear overreaching government violations of our liberties, the weaker we become when we enforce our liberties against said overreaching government.

I remember reading about target shooter that would do this to get a longer sight radius with iron sights. It was called a bloop tube. If you do it I would leave the muzzle end open or I would sleeve it so that the end isn't capped with anything that someone could call a baffle. Think about a fake can silencer. There is an inner sleeve that is just a little bigger than the bore and then a larger tube for looks.

Obviously, I'm not what you'd call a legal scholar but it seams to me pleading "ignorance and/or stupidity" might not be the wisest course of action.

Correct me if I'm wrong, if you "accidentally" do something illegal, there is no criminal intent but, if you intentionally do something that (know it or not) is illegal, you are hosed.

                Unwise

It is unwise to go sticking anything that looks like 'pipe' on or around your muzzle, since it acts (even unintentionally) as a sound dampener.

Sure, it sounds silly, but that's how the law is written.

You might be right, but it will cost thousands of dollars to prove you are right, over a $1 piece of pipe.

                2008 Dangerous Weapons Control Law
                12500 thru 12520 Silencers

                CHAPTER 5. FIREARM DEVICES
                ARTICLE 1. GENERAL PROVISIONS
12500. The term "silencer" as used in this chapter means any device or attachment of any kind designed, used, or intended for use in silencing, diminishing, or muffling the report of a firearm. The term "silencer" also includes any combination of parts, designed or redesigned, and intended for use in assembling a silencer or fabricating a silencer and any part intended only for use in such assembly or fabrication.

Sure, there is an intent requirement, but would you really like to argue that in court? "Honest Judge, my evil Nazi German MG-42 look-alike wasn't intended to be quieter, just look more scary..."

Isn't there a 10/22 MG42 dress up kit already out there? Do MG42s use a heat shield on the barrel?

My opinion is that if you are trying to copy this, then the only thing you would be guilty of is copyright infringement for the dress up kit.

                  Also......

................... So does this mean that anyone with an empty plastic soda bottle is in possession of a device capable of being used as a silencer???

I dont think it'll be a problem. The GSG looks like its got a silencer but its fake. But, what I would do is call up your local LE and ask them if its possible.

Well the law seems to be saying that the part must be intended or designed to silence, niether of which I plan to do. I will have to try it and use a decibel meter.

As for the dorms, I dont live in them anymore, and I will be building this over summer, back home in Sac. I wouldn't dare even say gun on campus. But I know someone named Gun, and I have accidently yelled out his name before.

As for the dress up kit, there is one, but it is something like 2/3 scale. I will not be infringing on any designs because I am using a real barrel shroud.

I guess if just a larger diameter pipe will even questionably reduce sound on a db meter, I will have to try putting a smaller diameter pipe in it, like a fake can. But, I have not figured out a way to do this yet. Dont want the bullet to rattle around inside the barrel now..

                        Thanks for all the input!

NO NO NO NO NO !!! Why do people always suggest that calling police will give them proper legal answers? One officer may tell you his interpretation of the law, and another will give you their own. In court, you will not be able to use the excuse "oh I called the police department and someone said I would be ok" !!!! Police are not lawyers, police, when they arrest you or charge you with something, are simply bringing you in front of a judge and lawyers who DO know the laws.

Please everyone! Stop giving advice to ask police about anything that can affect your liberty!

Not only that, but police are PROSECUTION-SIDE. Same with the CADOJ and the BATFE and the various District Attorneys. That's the biggie--understanding that these people are REQUIRED to oppose us if we are detained, arrested, or brought to trial.
