    Safe affidavit?

    When buying a handgun or rifle do you have to sign a Safe affidavit?

    When I bought my handgun a few years ago and dros'ed i didnt have to sign one, transfering my lowers now required me to. whats up with that?

    of course I have a safe though.

    Is it for the FFL's benefit? or required by law?

    Required.

    Keep in mind most new handguns come with a lock so no safe affidavit is needed. Most likely why you didn't have to fill one out.

        got it, I was wondering why my ffl had asked because he didnt ask before. my savage rifle came with the cable lock.

        my hangun i bought 2.5 3 years ago came with the cable lock too.

        But is it CA law that you have to have a safe for rifles? or could a person just use the cable lock it came with?

          not law...yet,

          but if you do not have a safe to lock up your guns..

          .they might go on a shooting spree


          but for real, some insurance agents/companies might deny your clame of lost/stolen if not lockup in said.

            Safe Affidavits no longer work when used in lieu of a gun lock. The Safe Affidavits are OK for California, but not for the Feds. IIRC the BATFE hasnt' promulgated regs outlining what is acceptable as a Gun Safe. So... Blame it on the Feds!

              Here is the skinny on safe affidavits: State and Federal gun laws overlap.

              Safe affidavits work in CA on lonnguns only. The Feds do not recognize the safe affidavit.

              Federal does not require a lock when you take possession of a longgun, only handguns.

              However, in CA you must have EITHER a qualifying safe or a lock for your longgun when you take possession.

              You MUST have a factory supplied lock with your handgun OR a CA approved lock for your handgun. The Feds require a lock, so the CA approved lock thing is just adding on to that requirement.

              So, before we get any more confused, if you buy a longgun, you must either have a safe, a factory supplied lock, or purchase a lock.

              If you buy a handgun, it must come with a factory supplied lock, or you must purchase a lock.

                So Matt, let me ask you this, I bought a used Handgun a couple of months back from out of state, it came with the factory lock, still in its OG package BTW. The FFL made me buy a lock, saying that even though it came with one, I had to buy one, he at least didnt overcharge me for it, but I didnt think it was right. He probably didnt like that he had the same thing for way more than I got mine for.
                This differs from your rules, as I DROS'd my P6 at your shop, which is my new goto FFL BTW

                Was he right or wrong?

                  If the firearm comes with a lock, it is good enough for both CA and Federal Law. What your FFL didn't know is how to create documentation to show that the handgun had a CA Approved lock sold with it. Most FFL's who understand this nuance generate a receipt that has a line item for the lock on it.

                    plus if you buy a lock yourself at a store other than the dealer, you have to show proof that you bought it within the last 30 days. not sure if that's part of the requirement from the state or just the dealer. the last gun i bought i brought a lock with me. i didn't have a receipt showing proof i got the lock in the last 30 days. low and behold i had to spend another $18 to buy a lock from the dealer. again, could've been that specific dealer that required it.

                      Gun lock prices at gun stores are like buying a coke at Del Taco. Thats ther bread and butter. I have seen gun store sell free gun locks that are given to you free from the police station. I quite asking.

                        Within 30 days is California law.

                        But after having purchased it, brought it with you to pick up the gun and proved you bought the lock within the last 30 days, neither California nor Federal law requires that you keep that lock.

                        Matt has it right. To directly answer the OP's question, no, it is not law that you either have a safe or complete the safe affidavit - but a safe affidavit is OK for long guns, if you don't care to buy a lock.

                          Gun stores do make a profit on the gun lock but it's not their bread and butter. Except when the get them free, what do they make on the sale, like $4?

                          And Turners of all places gave my neighbor, an 18yo 1st time gun buyer, a gun lock they sold him for like a penny in a gesture of goodwill and sent him 2 $10 off your next $50 or more purchase coupons in the mail! I never got anything like that and I've bought like 20 guns from them over the years!

                            My safe affadavit tip - write your make and model info on your HSC card, so you will always have the info handy.

                              Enh.. Keep a copy of a filled out Safe Affidavit in PDF on your website since most every CA FFL has a net connected computer...
