    OVER 50 SALE

    is it legal to buy a relic and take it home right away with a old bolt rifle. i bought a bolt rifle from a small gun store 107 years old and still had to do everything you do with a new gun. what is the law on this.

    Private party, yes, cash and carry. Ffl dealer has to do dros regardless

      1899 and newer needs to DROS from a dealer, if there is clear proof that it was made in 1898 or before it is antique and not considered a firearm.

        The only legal way to cash and carry C&R in this state from a FFL01 is to have a FFL03 and a COE. Otherwise they are treated like any other firearm.
        Limit politicians to two terms. One in office and one in jail.

          (Don't see anything in there that explicitly says FFLs must, or need not, do the full-on DROS).

            Antiques may be technically exempt, but most FFLs dont care and will DROS

            It needs to be older than 114 years anyway

              Don't forget even with the 03/COE combo you will still need to DROS and pay state fee.
              Yes you can have 2 C&R 03 FFL's; 1 in California and 1 in a different state.

                Bingo! and it was only 107 years old; ergo C&R. So, from a dealer one cannot use the >50 year old long gun private party exemption that was codified in section 12078 (t)(2) -- old PC numbers. Dealer must DROS and 10 day wait unless the buyer has both a C&R plus a COE to exempt from the 10 day wait.

                  what about a private sale of an antique pistol?
                  I've got a revolver for sale that was made before Jan 1st 1899.
                  Its a 32 S&W that will fire metallic cartridges.
                  I know federally I'm OK to sell it as a non-firearm, but does it require a DROS in CA?

                    Private sale of ANY antique pre-1899 is cash and carry. Period.

                    In the old days with the long 21 day wait, I remember C&R rifles could be taken home the same day. Now EVERYTHING post 1898 from a dealer is a 10 day wait.

                        You can currently still buy a 50+ year old C&R long gun cash and carry from a private party at a gun show in California. Some sellers at gun shows are just private parties and not licensed dealers.
