    SKS questions

    I was wondering if all versions of SKS are legal here in Ca.? My Father has one he is giving me but sure if it is ok or not in Kommiefornia. Any one know? Is it a C&R?

    Chinese are not C&R.

    Yugo's with GL are illegal.

    All SKS marked rifles with a ditachable magazine are illegal.
    Yes you can have 2 C&R 03 FFL's; 1 in California and 1 in a different state.

      What type of SKS does he have?

      Most are OK in CA, but there are some that aren't.

          Not too sure, he and the SKS are in Ohio. I will have him send me the serial # and any other marking on it and let you know. He gave me his AR a while back but can't bring it here because it is an older Colt sporter 2, and I believe it is on the ban list.
          I have my 03FFL but too bad It doesn't qualify me for those.

              There are no Russian or Romanian Colt Sporters.

              Now back to the SKS. Because the firearm would be coming from his father, he wouldn't have to worry about the SKS being 50+ years old. It would just have to be C&R. The "family" aspect of the transfer exempts it from California's requirement to go through a California dealer. If it's a Yugo M59/66 there is still the grenade launcher to contend with.

                Just to nail down the Colt Sporter -- It's banned by name in appendix B of the AW rifle flowchart.

                  Yes sir I know the Colt is banned that's why I have never brought it back.

                  The SKS has a fixed mag well he said it is top load only, and that it is chinese.
                  is that ok?

                    Norico's/ chinese are legal but not C&R
                    Romanian it depends on the year
                    Russians are mostly C&R but check the year
                    If it is a rare model that accepts AK mags, They are completely a big no no, but valuable.

                      SWEEEEET... thanks for the info, I guess I will have an SKS soon. He said he paid about 100.00 for it a long time ago at a gun show out there. Now I'm excited to get it here.

                          Really? I thought an inter-family transfer didn't have to go through an 01/07 FFL. I thought I only had to send in my $19 and the state form for this... am I wrong?

                          BTW, not sure if it helps here or not but I have an 03FFL

                            You have an 03, therefor if it's over 50 years old you can do a face to face in CA or out of state and bring it in, no fee's, no paperwork, just log it and you're good.

                            If it's not 50 years old but listed as a C&R (Not Chinese) you can take possession of it outside of CA due to your 03 and bring it into CA, as long as the transfer happened outside of CA your in the clear. Just log it and go on your merry way. If you want to do the transfer inside of CA you must go through a dealer, no FTF on rifles newer than 50 years.

                            Since it's not a handgun you don't have to send the $19 to the state.

                            If it has a Grenade Launcher you have to take care of that issue before it enters CA.

                            If it's Chinese it has to go though a shop as it is not a C&R, no matter location.

                            If it has a detachable mag it's a no-go in CA.

                              Yes really.

                              Federal law requires that a transfer between residents of different states must be completed by a dealer in the home state of the new owner. The federal law does not have an Intra-Familiar exemption.

                              You said that this SKS is a Chinese model.

                              I and others have told you that the Chinese SKS is not C&R eligible; your C&R FFL is of no help to you for a non-C&R firearm.
