    Interesting C*R question (law)

    OK so here is the deal, looks like I will be handed the keys and family empire here shortly as my parents plan to retire. Documents and such are in the mail and have been finalized by the family lawyers etc...

    So here is the cool part. My families property is located in North Carolina which is a 2nd amendment loving state. No goofy or retarded laws like we have here.

    So here are some questions.

    1. Can I use my CA C&R license to ship things back to NC? My name will be on the house so technically I would be shipping to my self right?

    2. Can I get a C&R license for the State of NC? Even though I am no longer a resident I still have my name on the families property.

    Yes you can get a second C&R for NC (I may get a second on for WA so that I can get my folding stock M1 carbine). Not sure about the shipping question though, who would be receiving them on the other end? You may need to list that person on your 03 Application.

      My Next of Kin would be getting it AKA mom and dad.

      So if where to get it re-done I would have to get my finger prints and such correct? I am not familiar with NC laws however they are not as strict as ours.

        You call legaly ship guns to yourself even without a C&R, just remember you cant use USPS for any handguns. If you are sending them to NC to have there for later I would just send them to yourself c/o (in care of) mom or dad and just to be safe tell them not to open the box. If they are CA handguns you will have to send paperwork to CA DOJ that you have moved them out of state.

        you can get a 2nd C&R...there are a few links here on calguns about doing it.

        (special thanks to morrcarr67) you dont have to get fingerprinted for a 03C&R FFL ... You have to be sure that NC has C&R as a few states dont and it will have to be logged into some kind of bound book. I would read thru that post and it should answer your questions.           Not sure about your plan, but here was mine that was more or less approved by CGN when I asked. With your 03 you can warehouse guns, I was going to just warehouse any CA assault weapons (folding stock M1, SVT-40, etc) in a safe at her house.

          The "problem" arises when BATFE shows up to review your records and collection. I would not be able to produce said weapons in CA. It was therefore suggested that I just get a second FFL in my name, at my mom's address in WA.

          If you plan on your parents getting an 03, then it is their collection and they could leave to you in the will (don't know if probate would be an issue or if you have siblings to compete with.) It also gets tricky if you buy the guns for their collection (straw purchase). I think that you should just get a separate 03 in your name (no fingerprints etc required) listing the address in NC.

          You will then be managing two collections and for the sake of clarity two sets of books. If you move a gun from CA to NC or back you should essentially transfer it to yourself from one book to the other.

            Irish Gunner is right on the money with getting a 2nd C&R in your name. it is very easy to do. I am not really sure 2 sets of books are needed. When I called OC ATF field office about getting my 2nd C&R the man I spoke with was not concerned with me keeping two sets of books as long as it was logged in somewhere and I was following all the C&R laws and not useing my licence as a bussiness for buying and selling. What I have done is I have one bound book ( a 3 ring binder) with 2 sections and I log things in under what licence I used to buy said gun so that I dont have to log in and out the same guns as I move them around. I beleive that you can keep one set of books because you are licenced not your property you only need the 2nd C&R so that the address will match up.

              The two sets of books is probably overkill, but it was thought that if you had two geographically separate locations, even the most anal retentive BATFE agent couldn't argue with a set for each site.

                I agree with getting a second C&R license in NC. Maybe not required; but for keeping things straight, I keep two A&D books -- one for each license. When you ship, I would include in the shipment a copy of both licenses marking one as sender and the other as receiver.

                I believe you can ship modern guns from CA to NC (from and to yourself) -- there's no ownership transfer; ergo interstate transfer of firearms is not an issue. It's a matter of finding which carrier who will accept your shipments according to their tariffs (rules.) I'm not a lawyer, so don't rely on that as the gospel.

                    SVT-40 is not a CA AW. Bring it in to CA and blast away

                        In my case I want to keep collectibles that the state of CA, in their infinite wisdom classifies as AW. The only way to keep those is out of state.

                            lol I think any state other than NJ and Hawaii are paradise compared to our gun laws here.

                            Well thanks for all the info. I think I will get a 2nd C&R for NC and get a 2nd A&D book just to be on the safe side. Also 2014 is coming up fast and I find it ludicrous we have to register C&R long guns and pay more bull **** fees. Now that an opportunistic chance has come about I would like to exercise my C&R in another state.

                            Plus I spend much time there and my immediate family is there so I know they will be in good and safe hands.
