Another...Help with CoE and FFL 03 application.

Hello, I have read the many threads on this forum regarding what I have an issue with, but those threads are so long and it is hard to pinpoint the answers I am seeking.

As I understand,
I need to get a Live Scan done first and then apply for CoE. And then I apply for FFL 03? Do I wait for CoE approval before applying FFL 03?

After being approved., do I get to just start buying C&R stuff right away or is there a wait period?

If I have guns that was eligible as C&R before getting this license, what happens to the status of those guns when I attempt to sell it? And I have hit my 5 selling transaction for the year. If I sell a C&R eligible gun that was previously purchased a before FFL 03 license, does that count as C&R sell or does it cause me to exceed my 5 limit per year?

Coe and 03ffl are 2 completely separate things in terms of applications. One is federal. Other is state. You can apply for your 03ffl whenever you want regardless of the status of a Coe. Most people apply for an 03ffl first as that takes longer. Then get the Coe.

Guns purchased before the 03ffl do not go on your books. They don't matter. Only thing that goes into your bound books are guns you purchased WITH the use of your 03ffl.

If it is a PPT, then it does count towards your 1 in 5. If you ship it out to another ffl, I don't think it matters. Let's say you ship it from socal to norcal. (someone double check me on this)

Or if another person has an 03ffl and Coe, then no dros needs to happen and can sell face to face and you can just report it on CFARS as no longer in posession.

What purchases can I get shipped to home, and what purchases must I go through a FFL01?
Is it still with 03, I would be able to acquire a C&R out-of-state and bring it back and only require myself to report it?

Are there a list of C&R guns someone can't have in CA? Does the ban/control on some accessories that applies to modern firearms apply to C&R? (Ex. 10+ round magazine, pistol grip?)

Any rifle SHIPPED in from out of state designated to you must be shipped to an 01ffl. Antiques can go to your doorstep.

03ffl you are allowed to acquire guns out of state and bring them in with you and you have to register them on CFARS.

If it isn't on the AW ban list by name then you can have them. AW "features" still apply. Same rules. Fixed mag or featureless for semis. No grenade launchers.

You can have firearms that can take higher than 10 round mags. You just gotta have mags limited to 10rds

That's not true.

If the receiving FFL has a California high cap mag permit they can receive them and block them.

If the California FFL doesn't have a high cap mag permit then they would need to be blocked out of state.

I can't help you with questions as to California's laws...I'm in Idaho.

Sales limits in CA still apply to people with valid C&R 03-FFL and valid COE.

Exemption to this for C&R firearm transfers (sales/etc) from a person with a valid C&R 03-FFL and valid COE to a CA FFL dealer are exempt from the limits. [PC 26585]

Requirements to be exempt from transfer limits:
1. Firearm needs to be a C&R firearm. [PC 26585]
2. Seller needs to have a valid C&R 03-FFL and valid COE. [PC 26585(a),(b)]
3. Buyer needs to be a CA FFL dealer. [PC 26585(c)]



Penal Code 26585
Section 26500 does not apply to the delivery of an unloaded firearm that is a curio or relic, as defined in Section 478.11 of Title 27 of the Code of Federal Regulations, if the delivery satisfies all of the following conditions:
(a) It is made by a person licensed as a collector pursuant to Chapter 44 (commencing with Section 921) of Title 18 of the United States Code and the regulations issued pursuant thereto.
(b) It is made by a person with a current certificate of eligibility issued pursuant to Section 26710.
(c) It is made to a dealer.
