    FFL03 C&R Instructions

    Hello,

    I received my FFL03 License a few weeks ago. I read around and expected to receive a manual for doing C&R transactions. I haven't received anything following the license, and I have some C&R firearms coming in this week.

    What are the things I need to record in my book, and what should I do on CFARS? Are these the only things I need to do?

    For CFARS, do I go with "Firearm Ownership Report", "Collector In-state" or C&R Firearm report"?

    You can expect an envelope from BATFE in a week or 2, sometimes it comes before the license, sometimes after.

      Download the big brown book and read the first few pages, it has a bunch of good info.

      Yes you can have 2 C&R 03 FFL's; 1 in California and 1 in a different state.

        On CFARS you do Collector In-state for guns you acquire in-state, within 30 days of acquiring them.

        You do C&R Firearms report for guns you acquire out of state, within 5 days of importing them.

          Does this still apply? I keep getting mixed statements about getting rifles that are C&R directly to me.

          Rifle shipments to CA must be made to a State licensed dealer or may be made to individual homes, providing that a CA Certificate of Eligibility and a Curio and Relic License are provided.

            From what I understand that Commifornia has their own version of FFL. Meaning other fed FFL has to buy into so they can sell in to California. For some FFL's they don't want to obtain that Cali FFL so they don't want to deal with Californians all together.

              CA laws changed in 2015...

              C&R handguns must be shipped to a CA FFL dealer, who will then transfer it to the CA resident.
              ^If the CA resident has a valid C&R 03-FFL and valid COE, then they are exempt from the 10 day wait and 1 in 30 day wait.

              C&R long guns that are being shipped from out-of-state into CA must be shipped to a CA FFL dealer, who will then transfer it to the CA resident.
              ^If the CA resident has a valid C&R 03-FFL and valid COE, then they are exempt from the 10 day wait and 1 in 30 day wait.

              C&R long guns that are being shipped within CA can be shipped directly to a CA resident with a valid C&R 03-FFL and valid COE.
              ^Within 30 days of receiving the C&R long gun, they must report it to CA DOJ BOF via Collector's Report of Instate Acquisition of Curio or Relic Long Gun (BOF 961).


              Under Current CA laws...

              Exemptions for a CA resident with a valid C&R 03-FFL:
              1. Importing a C&R firearm that they physically acquire while outside of CA without needing to utilize a CA FFL dealer. [PC 27585(b)(1) & 27565]

              Exemptions for a CA resident with a valid C&R 03-FFL and valid COE:
              1. No 10 day waiting period when acquiring a C&R firearm from a CA FFL dealer. [PC 27670]
              2. No 1 in 30 day wait on handguns. [PC 27535(b)(9)]
              3. Can be used as proof of CA residency. [PC 26845(b) & 11 CCR 4045 d.1.]
              4. When acquiring C&R firearms, it is an exemption to needing a valid Firearm Safety Certificate. [PC 31700(a)(6)]
              5. When acquiring C&R firearms, it is an exemption to needing to do a safe handling demonstration. [PC 26850(h) & 26860(g)]
              6. Acquiring a C&R long gun inside of CA without needing to utilize a CA FFL dealer. [PC 27966]
              7. Acquiring ammunition from a person within CA without needing to utilize a CA DOJ licensed ammunition vendor. [PC 30312(c)(6)]
              9. Either online or in person, importing ammunition acquired out-of-state without needing to utilize a CA DOJ licensed ammunition vendor. [PC 30312(c)(6) & 30314(b)(5)]

                I'm not quite sure you're correct on that based on the PC you're quoting.

                PC 30312 (c)(6)


                (c) Subdivisions (a) and (b) shall not apply to the sale, delivery, or transfer of ammunition to any of the following:

                (6) A person who is licensed as a collector of firearms pursuant to Chapter 44 (commencing with Section 921) of Title 18 of the United States Code and the regulations issued pursuant thereto, whose licensed premises are within this state, and who has a current certificate of eligibility issued by the Department of Justice pursuant to Section 26710.
                Nowhere in exemption (c)(6) does it say the person delivering the ammunition needs to be exempt, only the receiver.
