    Shipping in state

I have a C&R, can I ship a long gun direct to someone in California with a C&R and COE and not to a dealer? And if so who do you recommend using as the carrier and does it need to be next day shipping?

    Thanks

    Technically, yes.
The C&R long gun transfer exemption does not prohibit shipping within CA.

Seller will need a copy of the buyer's C&R FFL for their bound book.
Buyer will need a copy of the seller's C&R FFL for their bound book.

Buyer will need to submit a completed Collector In-State Acquisition of Curio or Relic Long Gun Report (BOF 961) to CA DOJ BOF within 30 days of receiving the C&R long gun.

    Penal Code 27966
Commencing January 1, 2014, if all of the following requirements are satisfied, Section 27545 shall not apply to the sale, loan, or transfer of a firearm:
    (a) The sale, loan, or transfer is infrequent, as defined in Section 16730.
    (b) The firearm is not a handgun.
    (c) The firearm is a curio or relic, as defined in Section 478.11 of Title 27 of the Code of Federal Regulations, or its successor.
    (d) The person receiving the firearm has a current certificate of eligibility issued pursuant to Section 26710.
    (e) The person receiving the firearm is licensed as a collector pursuant to Chapter 44 of Title 18 of the United States Code and the regulations issued thereto.
    (f) Within 30 days of taking possession of the firearm, the person to whom it is transferred shall forward by prepaid mail, or deliver in person to the Department of Justice, a report that includes information concerning the individual taking possession of the firearm, how title was obtained and from whom, and a description of the firearm in question. The report forms that individuals complete pursuant to this section shall be provided to them by the department.

You can use USPS, and overnight is not required. Just be sure to insure it, use tracking and adult signature required.

And if you don't know this person, you may want to call ATF and verify the ship address matches their 03FFL and the FFL is still valid. Do not ship anywhere but the address on the 03FFL. The risk is that the FFL document does not belong to the person trying to pass it to you, and could be forged. This is easy to do when exchanging documents electronically and it has happened, scammers pass fake FFLs regularly.

There is no law that says you have to ship to the FFL address, but as a rule you'd probably require that if you don't know the person.

I had a conversation with the ATF about that when I got my OOS C&R FFL. When the ATF agent in NV saw my CA address for my contact information he wanted to know why I wanted an FFL in NV. He said: You know you can have a firearm shipped anywhere you want. I said that I knew that but asked him of how many FFL holders he knew of that would ship a firearm to an address other than the one listed on the FFL? He said he didn't know of any and thanked me for my call.
          Yes you can have 2 C&R 03 FFL's; 1 in California and 1 in a different state.
