    Sounds like his wife, your mother's sister, is still alive? If so, it passes to her. If you want the AK she can transfer it to you as a private party transfer.

      The rifle now belongs to your aunt. She can meet you at a gun shop and you can do a private party transfer there. It will cost you $35. Keep in mind not all shops are up on the law and some do not feel comfortable transferring AK type rifles. If you're not sure where to go, give us a location and I'm sure someone local can point you in the right direction.

        Thank you for the responses. My Aunt lives out of the US and doesn't plan on coming to the US at all. What should be my direction then?

          If you aunt can't transfer it to your name and she is ok with giving it to you take apart the gun and destroy the receiver. Then buy a 80% lower and join a build party. This is something you may want to consult a lawyer about...

            ^^^^ this exactly, destroy the receiver (cut in 3 places, behind front trunnion through trigger section and in front of rear trunnion) make sure the whole center section gets destroyed and then go get an 80% receiver and build it... keep it legal if you want the rifle that bad.

              Also, the whole "transfer it into your name" thing is wrong. While it needs to be legally transfered to you, it will not be registered to you or anyone else. It isn't "in anyone's name" now and it won't be after a legal transfer is made.

                  Reciever does not need to be destroyed unless it is an MG. If not an MG, just demill the gun and leave the reciever behind.

                    If you think it may have at one time been registered as a RAW then I would consult a lawyer. If it has been, the person in charge of the estate could get into some legal issues.
                    Been gone too long. It's been 15 to 20 years since i had to shelf my guns. Those early years sucked.

                          California laws are so $#@$ed. In Texas, there are no "transfer forms" or fees for this. With your aunt's consent, you could just take the AK.

                              Wow you guys missed completely.

                              You need to contact the BATFE and Homeland security to see what has to be done to import a family heirloom that is a firearm. Also look for importers of firearms. Be advised that because it is an AK type, it could be considered an "implement of war" and would need to be chopped up like any other parts kit.
