    Assault Weapons

    For Category 3 assault weapons: Centerfire rifle with capacity to accept detachable magazine, with at least one "evil" feature,

    1. If it doesn't fire because of one or more missing parts, is it still assault weapon?

    2. If the complete upper and complete lower are separated, is it an assault weapon?

    3. Category 1 stripped lower receiver, is it assault weapon by itself?

    4. Making a gun for your own use, and not having any marking is okay per ATF. Does California accept that as a legal firearm?

    I know the DOJ doesn't recognize constructive possession.

            3. is NO since you can make it a .22 LR, a featureless rifle, 10 shot featured, or a single shot rifle.

              1. Yes. LEOs can arrest & confiscate for possessing a "broken" assault weapon. There have been prior criminal convictions for possessing "broken" assault weapons and there has been a recent Appeals Court ruling supporting this. It is recommend that you store/transport parts separately (do not keep all the parts together in a single location).

              4. Yes.

              Due to the Appeals Court ruling, it is prudent to assume "constructive possession" of assault weapons can now equate to arrest/confiscation by CA LEOs.

                4. You can make a firearm for yourself, and only for yourself so long as it stays in a CA legal configuration AND you can legally own a firearm.

                        I have seen some people built totally illegal rifles. Short barrel rifle with all the Cat 3 features. Taking out bullet button for regular mag releases...

                        No good.
