80% lower question

    80% lower question

    I have a 80% lower which i finish into a 100% working lower. Can i legally give it away if i dont want or need it anymore?
    EX: if i sold my upper, lower part kit with buffer spring, stock and all than decided i give the lower away to the buyer(free) since i would have not use for the lower once all the other part are gone. Is this legal or would it still consider illegal since i'm transferring it to someone else. Please give me your thought, tips and advice on this matter.

    I'm asking because i'm thinking of parting way with my expensive hobby and also because i have a baby on the way n could really use the fund.

    nope.

    the only way to transfer a completed 80% is to serialize it and do a regular transfer through a FFL.

    you could sell it for $1 though if you went through the serialization etc.

      Once you've completed any features beyond the 80% mark I believe its considered a firearm an must go through an FFL to be legal. With that said, in order to transfer the lower it'll have to have all the required ATF markings (S/N, mfg name, etc).

        if you've started working on it, then no. If it is as you bought it, then yes you can give it away. If you need any information on it, check the link in my sig and feel free to PM me.
        My AR is 7.62x39, so that if/when we get invaded, I can shoot their ammo back at them!

          sell all the parts and as others have said put all the correct info on the lower then sell through a FFL or scrap the lower per ATF guidelines (3 TORCH cuts)

          I personally would just destroy the lower cause selling a hoimebuilt lower seems like a easy way to get manufacturing charge on your record since you should have built it for your personal use without the intent of saleing

                    How about if one found a lower in a trash can or in a wood? Given it is not serialized or tracked from the manufacturer, how does the ownership identification work?

                      That's my thought, I understand the transfer but what is stopping some one who did that to just give it to a friend? will the men in black come knock on the door ?

                        ^ I would say that posting how do I transfer my lower on an internet forum, then not being able to account for it later might help identify at least something for law enforcement to look into. When it is so easy to serialize a lower, why take the risk?

                          Proof that you did the work? Build party receipt? Pics showing you at a mill? Even having basic knowledge of machining procedures?
