First off, forgive me because I am completely confused with all of the conflicting "information" from different sources.

My mother in Georgia is trying to gift me a non-rostered HK handgun. Can A;

Either I go there pick it up from her and bring it back or she brings it into CA with her and transfers it to me and I submit the Intra-Familia Handgun Transaction form

or B;

Have her send it to me through FFL's on both ends?

Gun Control Act of 1968

Because of Federal laws that have been in place for about 45 years...

The handgun must be transferred through a CA FFL dealer.

The handgun can not be a prohibited weapon (DD, MG, SBR, SBS, assault weapon) and can not include any large capacity (11+ round) magazines.

You must be 21 years or older and have a HSC or be exempt from the HSC.

Therefore...
1. Your parent can ship the handgun to a CA FFL dealer or deliver the handgun in person to a CA FFL dealer.
2. The CA FFL dealer will then transfer (4473/DROS/10 day wait) the handgun to you.
3. You will pay a transfer fee & CA use tax.

Prior to the handgun being imported into CA, you must find a CA FFL dealer that knows how to do out-of-state intra-familial gift transfers and is willing to receive a shipment from a non-FFL. This is because not all CA FFL dealers know about and/or are willing to do out-of-state intra-familial gift transfers and not all CA FFL dealers are willing to accept shipments from a non-FFL.

Does CA use tax apply to "gift" transfers? My FFL did not collect tax on my transfer.

I would also add that when you find an FFL, ask what the fee is upfront. There is no maximum that can be charged.

I remember reading you can still do Intra-Familia Handgun Transaction, my dad's gun is still under his name, i have yet to do the transaction. But then again my dad lives with me so no need to do it.

That would be a INTRA-state and intrafamilial transfer so Feds not involved, only CA DOJ. The OP is inquiring about an INTER-state intrafamilial transfer. Feds care about the interstate aspect.

I am in Irvine.

I have tried a couple of different places. I had been told by a person at the Stockade that it could be done without FFL's but when I called back I was told another story by another person. Turners told me they would not help at all. I would image that Mike at OC Armory could help but he always seems to busy and I would think his first inkling would be to single shot it.

My hesitation there is I do not want any chance of voiding the warranty even though I have been told there is no way of knowing it was done.

OC Armory is up on this and so is Riflegear. Contact either one of those store and they will get it done for you. Enjoy your new HK.

no noticeable stuff just swap barrel to be over 6 inchess and a 0 round mag

yes legal to covert it to any legal config Semi suto is a legal config in CA and fed level

but i might be wrong since its interfamily I dont think the rooster comes into play some one can correct me if im wrong

You don't have to single-shot convert it. It is an interstate, intrafamilial transfer. Off-roster handguns can be transferred in this manner.

Your mother can ship it to the ca ffl, or deliver it there in person along with you. She will need to write out a short note stating who she is in relation to you (use both your full legal names), and that she is giving you [insert description and serial number of gun here], sign it, date it and give it to the ca ffl that is doing the transfer.. If she doesn't personally deliver it to the ffl, the note goes in the box with the gun for shipment along with a copy of a photo id (drivers license works).

It is a 10 rd mag and nothing more can be brought in to the state not 11 rd plus.I'm not talking about rebuild kits.
