    CA Roster Question?

    So I see that the handgun I am looking to purchase is on the Roster of Handguns Certified for Sale but it has an expiration date of 1/18/13. Once it expires what happens?


    Do they renew it right away?

    How does this work?

    Practically, it means you shouldn't order one just now, because dealers may not be able to transfer it at the end of 10 days waiting.

    Usually the manufacturer renews it and a new date is entered for the Roster. Depends on how efficient the mfrs are and how busy DOJ is.

    Frozen in 2015, it is falling out of date and I can no longer edit the content. But much of it is still good!

      Really? I would think that if you started the DROS before the expiration date that you would still be able to pick it up if the manufacturer doesn't renew it.

      But, then again I've been known to think wrong.
      Yes you can have 2 C&R 03 FFL's; 1 in California and 1 in a different state.

        I think 'it was on the Roster when we started DROS' should be enough, but anecdotes suggest FFLs may be more cautious.

        Actual code makes it a crime if a person
        manufactures or causes to be manufactured, imports into the state
        for sale, keeps for sale, offers or exposes for sale, gives, or lends
        any unsafe handgun
        but doesn't say 'deliver'.

          Thanks guys. I will just find a model similar to this one that has a further expiration date.

            There is an exemption that allows it to still be delivered. [PC 32015(b)(3)]
            But, it depends on the reason why the handgun was removed from the Roster of Hadnguns Certified for Sale.

            If the handgun was removed because the manufacturer/importer/distributor didn't pay the renewal fees, then it can still be delivered.
            If the handgun was removed because it failed a safety test, then it can not be delivered.

            Therefore...
            If the handgun was on the Roster of Hadnguns Certified for Sale when the handgun was DROS'd and then the handgun's listing was removed, because it was not renewed, during the 10 day wait; then the CA FFL dealer can still transfer the handgun to the buyer.



            Penal Code 32015
            (b)(3) If a purchaser has initiated a transfer of a handgun that is listed on the roster as not unsafe, and prior to the completion of the transfer, the handgun is removed from the roster of not unsafe handguns because of failure to pay the fee required to keep that handgun listed on the roster, the handgun shall be deliverable to the purchaser if the purchaser is not otherwise prohibited from purchasing or possessing the handgun. However, if a purchaser has initiated a transfer of a handgun that is listed on the roster as not unsafe, and prior to the completion of the transfer, the handgun is removed from the roster pursuant to subdivision (d) of Section 32020, the handgun shall not be deliverable to the purchaser.

                I decided to go with the Stainless TLE/RL II instead. Which does not expire until December.

                    I had a similar concern with a gun I have on order. I just went to the manufacturer's site, found the contact us link, and sent them a quick email asking if it was going to be renewed. They confirmed they would be renewing it and assured me it would be renewed in plenty of time. It's worth a shot if you still want the one you were first interested in. Good luck.
