    Well thanks to the anti self defense wackos, were not allowed to kill someone thats just trespassing in our home. They have to be threatening you from my understanding. I whole heartedly beleive you should be able to kill an intruder simply for breaking and entering, but i'm pretty sure we cant... am I wrong?

      Not sure what state you live in, but assuming it is CA, consider reading PC 197, PC198.5, and PC199. Guns laws suck in CA. Self defense laws however are and have been among the best in the country. Civil immunity would be nice, but most states don't have that either.

      If somebody is in the process of or has broken into your house, you get to assume they intend to kill you and act accordingly.

        Well then disregard my last post, I was told several times that they need to be wielding something or coming at you in an agressive manner. Thank you for the facts, i like that. I will still hesitate if i dont sense a serious threat, thats just what the law makers in this state have inflicted on law abiding people.

          In another thread I said I keep a mossberg 590 next to my bed, but I really don't. I keep err-thing locked up in the safe.

            It is my understanding that they do have to be wielding something or coming at you. Either way, you will still most likely see a court room and be defending yourself. Remember... this is CA. It would be a lot better if you could say "they were coming at me with a bat".

                Not really. Self defense is a valid civil defense and you will have a statute (which is not limited to any particular section of law) saying that you felt fear for your/your family's safety due to the circumstances. You don't have civil immunity however and your insurance company will likely settle for 5-10K to avoid court even though they know they could win. The only civil defense I know of to avoid the above is to counter sue the intruder's estate for the damages he caused you, but again the legal fees will make settling and forgetting seem like a great solution.

                  A peacefully sleeping dog is better than a paranoid sleeping human. especially my german shepherd who hears everything.

                  for that reason the pistol is in a bedside safe, unchambered, mag in.

                    Same here, I have a Chihuahua and a American Staff/Black Lab mix that hears everything but my XD is loaded but not chambered, if I really have to shoot it will be shoot to kill.

                      Bedside weapon? I keep a loaded mag within easy reach, but my gun locked away. I do keep a Surefire M6 light with a 600 lumen mod at my bedside and a hatchet nearby.

                              I have my pistol next to my bed and my 12G is three feet away. And if there is the slightest possibility that an unlawful treaspasser may cause bodily harm to myself or my wife then I will take swift action to prevent this. I will not even think about wether or not his family will sue. And I have a feeling he will have an unmarked no serial number handgun in his hand when police arrive ;D
