    Transporting Inherited revolver


    The answer is probably here but I could not get to it trying a search.

    I have an old - mfg between 1930-1935 - H&R .22 Revolver located in California. I live in Arizona. It is essentially an inheritance from my father to me. Never ever had any paper attached and entered California in 1959-1960. I've lived in an moved out of California all my life ( off and on) which probably doesn't matter since I am in Arizona now. My dad died a few years ago (89+), the pistol is at the family home in California. My mother (89+) is now moving to a Colorado rest home and she wants me to come get the pistol. Big long story! But legally (although not in any kind of will) from my dad to me or from my dad to my mom to me. Again big long story.

    So -any one ever had to deal with this sort of thing. Can I just go get it & put it in 3 locked containers in my PU with no ammo anywhere and drive back to Arizona? Can I ship it to myself from CA to AZ? Can I break it down and ship the parts separately? Any issue with the revolver frame being shipped - UPS, FEDX ???? FFL to FFL CA to AZ??

    Every time I read all the Kalifornia Firearm stuff I get sick to my stomach. I'm concerned that Murphy will raise his ugly head and I'll get a flat tire or something, get searched and get caught up in some kind of "issue". There is no real $ value to the Revolver - $50 maybe it its current well used shape. But has a lot of value to me.

    Inheritance does not require an FFL; transport would be 'unloaded in a locked case'.

    BUT ...

    You can't inherit from your mom until she passes on and the estate would be distributed. Without a will showing dad to you, you can't legally go pick it up and take it home.

    That would be CA-mom to AZ-son(?), and CA - > AZ is interstate transfer. Feds require that you use an FFL in AZ to receive the gun.

      OK - Thanks. What are the issues in California if she took it to a FFL in CA to ship to a FFL in AZ. What needs to be done - Calif- wise???? Does she have to be somehow registered then the gun registered???????? I'm a little concerned because of her age - she still thinks she can just stick it in a box and mail it to AZ.

      Dad gave the gun to me when he was still alive. He split up the guns between me & my brother. But since it was his first gun he ask me if he could keep it for awhile in case he wanted to shoot it some time. Of course I said yes and of course he never picked it up again. Nothing at all in his will (because he had already given it to me) except will said when when he died everything went to Mom. So I'm stuck with it belonging to Mom now.

      I'm trying to figure out if it is just better for her to move to Colorado then do the FFL swap/ship or just go ahead and do it in California.

      Appreciate the input.

        Mom can send it directly to an AZ FFL for transfer to you in AZ. Be sure the FFL in AZ is willing to accept shipments from a private party.
        Yes you can have 2 C&R 03 FFL's; 1 in California and 1 in a different state.

            Neither states nor Feds care who it is who ships TO the FFL, but the FFL may care; some prefer to receive guns only from other FFLs.

                Wait, if your father gave it to you, before he died, then it belongs to you. It would not be part of the estate when he died.
                I believe that it belongs to you and you can just go pick it up.

                  I agree with you - but in life you know there always complications and I am looking at worse case scenarios to determine which way I'll go. My Dad gave it to me. My older brother got his pick first and picked his up first. Then (months or years later - I really don't know which it was now) - when I was down to visit he gave me the ones he had left. Pretty clear then and like I said later he ask me if he could keep the .22 for awhile and I said yes and my Mom was sitting right there. Years later my Dad dies - not in a good way and not a good family situation afterword. Now my Mom thinks it's hers to deal with, told me she is giving it to my brother as the eldest son which complicates the matter since it was not dealt with in the will. He is out of Sate in the other direction and told her to give it to me. So within the Family it goes to me but by Law (which law- who's law?) it looks like it was never just mine - Dad to Me along time ago. I wished I would of just picked it up when Dad died. End of story.

                  I have a healthy dose of paranoia concerning the California gun grabbers. Sad since I was born in CA. Lived and worked from one end to the other and east to west. Moved out - came back- moved out -came back- moved out stayed out.

                  I know I am over thinking this.

                    Remember that handguns cannot be mailed by non-FFLs. Your Mother will have to ship by UPS, FedEx, etc from one of their shipping hubs, not their retail storefronts and they require overnight shipping for handguns.

                      Yea - use the mail- go to jail! But I thought that applied to everyone. Are you saying FFL's can ship handguns thru the mail???

                      Looking over UPS shipping reg's they will ship but it looked like FEDEX wouldn't ship unless you were FFL. Some differences between orginazations.

                      I thought an individual non FFL could ship direct overnight air via UPS Hub to a FFL??????

                      How can an individual ship to a Gunsmith with out going through a FFL and if that can happen how can a FFL Gunsmith ship it back to the original sender??
