15 round mag illegal?

    15 round mag illegal?

    So some how when my father took my beretta 92fs out to the desert to shoot with a buncha buddies he acidently brought back one factory 10 round and one 15 round mag.

    (I assume someone else had one as well and he just picked it up thinking it was ours)

    Anyways so now i have one facorty 10 round and the other is a 15 round mag.

    Is the 15 round mag illegal?

    Dad needs to give it back to his buddy. Legal/illegal isn't the question to be asked here.

      If there really is a buddy, then said buddy isn't going to be too happy that his 15 round mag has been replaced with a 10. Give the mag back.

        Hi cap mags are one of those things that, IMO unless you can prove you've owned it pre-ban, I probably wouldn't screw around with it buddy or no buddy.

        Felonies aren't a good thing. Guns are not your right, they are a privilege granted to you by the California Department of Justice. If you think otherwise, you are sadly mistaken.

          It is not illegal to possess high capacity magazines nor is it illegal to use them. You are not required to prove how or when you obtained them, and all you must simply say in regards to your legal high capcity magazines is "they are mine".

          Of course it is still illegal to import, give, sell, or manufacture high capacity magazines. It is up to interpret that.

              I understand what the law is, and I don't advocate breaking the law, but actually I, and many others, believe it IS MY RIGHT to own any firearm and magazine I choose. It is the state of California that has unconstitutionally abridged those rights.

              That said, the magazine should be returned to the owner, not due to any possible legal actions, just because it belongs to him..

                  Its not even belief. Its a constitutional right gauranteed to you. However, California doesn't seem to recognize higher authorities because they believe they are the highest authority.

                      Seriously? No disrespect but guns ARE NOT a privilege granted by CA DOJ by any stretch of the imagination. What do they say about the RIGHT to bear arms again?... Oh ya we have it. Op, as others have said its best to give it up and never have to worry about a story to tell.

                        I believe that post is simply referencing the facts on the ground.There's 'the law',and there's liberal policemen and District Attorneys who consider civilian posession of arms to be a public safety hazard.Such people look for any reason possible to conficate arms and invalidate someone's RKBA.

                          I'm sure he wants to give it back to its rightful owner. I don't know if finding and keeping a standard capacity mag is illegal or not, but you could get hassled if you use it at a range. It really depends how old you are. Is it plausible that you would've owned a handgun in 2000?

                            YOU are sadly mistaken, friend. I understand the intent of your post, but I do recommend you reread the 2nd Amendment:

                            "...the right of the people to keep and bear Arms, shall not be infringed."

                            It's the CA DOJ that has infringed on that right.

                            That said, the law is the law, and we don't want our rights aren't infringed any further because people don't abide by it.
