    Gift From Brother

    If my brother that lives out of state gives me a pistol as a gift is OK to have the high cap mags that come with it or do I have to get rid of them and get 10 round mags? The mags gotta go dont they?

    Couldnt get anything with the search.

    Well your brother would have to first gift it (gun) to one of your parents and then they would inturn gift it to you. The mags would have to be disassembled into rebuild kits and either sold as such in CA. or saved for use outside of CA. They could not be assembled into mags anytime in CA.

        The gift thing is from parents only? I didnt know that. Damn, I have been out of the loop too long.

            Yup, direct inheritence line only. Grandparent, parent, to son/daughter. No sibling to same, cousin to same.

              Yes fully assembled, functional mags are resticted to 10rds only if you are not exempt. However in your case your family can dissassemble them prior to shipping to Ca. While in CA. you can legally posses the dissasembled re-build kit.

                Your brother can still give you a handgun as a gift, but it would have to be on the Roster; brothers can't use the intrafamilial transfer route, so brother/brother has to be the same as all the rest of us.

                But yes, the over-10-round mags must be disassembled or omitted.

                      Transfer issues of the weapon aside, have him give you disassembled mags and you can use them:
                      When you leave CA and return to America (disassemble before re-entry or you're importing),
                      When/if the bedwetter law is overturned and you can have 'standard' cap mags in CA

                          so, if my sister in idaho, purchases a handgun to gift it to me for my birthday, and it is a non-ca piece, i can transfer it through a ffl and just have to "fix" the mags?

                            If it's on the Roster, probably that's all it would take; because it has to go through the FFL, and sister-brother is not within the intrafamilial rules, has to be on the Roster.
