    Hypothetical Off-Roster Handgun Questions:

    If one of my parents lives in Colorado, can they purchase a handgun specifically for the reason of gifting it to me, a California Resident? Can I pay them for it? Do I need to register it once I get back into California? What kind of paperwork would need to be done between my parent and myself?

    Also if you think of anything that might be pertinent that I haven't asked, feel free to add that too.

    They can give you an off roster gun all day long and twice on Sunday.

    The thing is that they must ship it to a ffl in CA for transfer. They should include a note saying that I Bob Jones is gifting the fine off roster gun to my son.

    This is not a PPT and the ffl can charge you whatever they want for this service.
    Yes you can have 2 C&R 03 FFL's; 1 in California and 1 in a different state.

      They can also deliver it in person to a local CA FFL willing to do an interstate Family transfer. Nothing wrong with you giving your Dad money anytime from any legal firearm. It is his Gun until the firearm is given to you and transfered legally.

        Gifts, however, ordinarily do not involve payment.

        A purchase with the intent to avoid the Roster is illegal (if perhaps difficult to prove).

          FEDERAL LAWS prohibits you from taking possession of a handgun in another state.

          In order to comply with Federal laws, your parent who owns the firearm must ship it to a CA FFL dealer, who knows about & is willing to do an out-of-state intra-familial gift transfer.

          Your parent must include a letter with the shipment. The letter should explain the relationship between the parties involved and that the transfer is an intra-familial gift.

          The CA FFL dealer can legally charge any amount to do this transfer (average price is around $75).
          So, finding a knowledgable & willing CA FFL dealer that doesn't charge a lot is the most important part of this type of transfer.

          The letter from parent explaining the relationship between the parties involved and that the transfer is an intra-familial gift is needed for the CA FFL dealer to use the intra-familial gift exemption to process the transaction.

          You will also do a 4473 & DROS + 10 day wait for the firearm.
