Interfamilial transfer?

    Interfamilial transfer?

    I had a question about interfamilial transfers. My brother lives in Texas and my father lives here in California. Can my my brother give my father an off roster handgun this way? I know if both were in state it wouldn't be a question. Just trying to avoid those nasty out of state fees.

    So what I'm guessing is my father can register it for the $19 fee and that should be it? Also as far as the gun goes can he just ship it to my dad or does he have to hand it over personally?

    Unfortunately, since it is an interstate transfer, an 01FFL is still needed.
    Normal FFL transfer fees apply, however, the transfer is roster-exempt.

    Scout local FFLs to verify that you find one that understands that the transfer is roster-exempt.

        Yup.
        Just saw that he's in OC. Perfect place. Reasonable transfer fees and they will recognize the law.

                Im a newbe from Washington State and will be down to see my son in long beach in a couple weeks and want to give him one of my pump shotguns a 30-30 carbine and 2 single action ruger revolvers.

                Do I need to do a transfer on this as it is father to son, long guns and only revolvers.

                    Thanks for the quick reply and sometimes I miss my Idaho days where I got the guns from my Dad with a handshake and then a hug................:

                      That's the same in CA; only if both are CA residents.
                      Yes you can have 2 C&R 03 FFL's; 1 in California and 1 in a different state.

                        Yup... father to son is GTG, though if it's a handgun, the son still needs to send in his $19 tax and file an OpLaw to transfer the registration.

                        And even in Idaho, a son in Texas can not ship a gun to a father in Idaho without going through an FFL. That is Federal law.

                        Federal law: All interstate transactions must go through an FFL and be in compliance with the laws of the states of residence of both parties.

                        California law: All transfers of handguns and long guns newer than 50 years old, other than intrafamilial transfers, must be processed through a California FFL.

                        So while is it legal for a Texas resident to travel to Utah and purchase a gun from a Utah FFL, a Californian must have the Utah FFL ship the gun to a California FFL (with certain exceptions for C&R).
                        But even the Texas resident can not go to a gun show in Utah and purchase a gun from a Utah resident private-party without going through an FFL.
