    Shipping Question PPT

    If I am going to buy a pistol private party on this site and the seller in Socal and I'm in Norcal, does the seller have to have a FFL ship the gun or can the seller disassemble the gun and ship to TO a FFL to do the transfer?
    Who is responsible for collecting sales Tax or does it need to be paid?
    I've used the search function and turned up a mixed bag. Thanks

    First of all its not a PPT its a transfer. I beleive the FFL can still charge you sales tax plus transfer fee but correct me if I'm wrong. Seller must ship it to your FFL.

      If you ship it, it's no longer a PPT, but a FFL transfer.

        Not sales tax if the seller is not a dealer.

          If a pistol is purchased from a private party and sent via mail, then it is not a "private party transfer" it is a normal "transfer."

          The shipper does not need to be an FFL, but there are specific shipping requirements for shipping of handguns. It must be via UPS or FedEx, shipped from one of their hubs, via overnight service, and the contents must be declared (ie: "unloaded pistol"). The recipient must be an FFL.

          If the seller is a private party, there is no sales tax to be collected since it is assumed it was already paid at some point by the original purchaser (the seller). The receiving FFL who will complete the transfer shall not collect sales tax, since none is due.

            OK the firearm is on the approved list. I just wat the transfer to be done by the FFL.
            My plan was to pay the seller and have him ship it to my FFL in sorcal to complete the transfer.

              Called one FFl so far and he said that the seller has to be present and if he is it's $35 otherwise a socal FFL has to ship it to the FFL up here and the price becomes $135. is this the norm? Sounds like a ripoff to me IMO.

                    Where in SoCal are you? If you're anywhere near Anaheim, I highly recommend Straightline Tactical for your FFL. Just shoot Don an email and he'll handle everything. Also, he only charges $50.

                            Have the seller go to a FFL. Have the FFL use a Gun Show DROS form and you fill it out. Have your FFL scan your CA ID/CDL and print the info onto the back of the Gun Show DROS form. Have your FFL put this form into the box and have him ship the firearm to the receiving FFL. The buyers FFL then does a PPT to the buyer. This is a LEGAL PPT. For safe measures I ask the SHIPPING FFL to also include the SELLERs right thumb print.

                              Call Rob Blank, he is in Milpitas and is an excellent FFL who won't rip you off.
                              RMB Enterprises, 408.946.5289, Milpitas. Next best is Roger's Relics in Santa Clara, but they are farther from you.
