If only the above unit is installed, we won't have 26". Would that still consider a long barrel pistol ?

Just a guess, I have the wire collapsible version and the wire stock sits within a 1/2" flush of the rear end of the housing tube when closed. Since fed law requires the gun to be OAL 26" my guess is that the basic unit, no stock, is 26" OAL.

If it's not - as in 1/2" or so short - Mech Tech sells a brake/comp that when attached to the muzzle will bring the OAL to + 26".

Just to be clear - the last few posts focusing on OAL are done with the goal of having the gun exempt from CA AW laws, not for determining if the gun when configured as a handgun (no stock) and using a fixed mag is legal in CA, correct?

+1. Thats my guess as well. Not sure exactly where the barrel ends, so no sure about how much receiver is behind it, but it looks like it could be around 26".

both. There are both federal and state issues if one ran it stockless and with a VFG. BATFE may say its an AOW, but if its 26", then it should be exempt from that opinion.

And per CA law, if over 16" barrel (and 26" OAL?) then it shouldn't be considered a CA pistol, so the pistol AW regs shouldn't apply. And if it never had a shoulder stock, then it shouldn't be considered a rifle, so the rifle AW shouldn't apply either.

Do you want an AOW or C&R SBS/SBR in CA?

"Never had a shoulder stock" - does that refer to the unit with pistol receiver assembled never having a stock attached or if the unit alone never had a stock attached?

Older Mech Techs came with a stock - a fixed type welded as part of the unit, a collapsible AR type or a collapsible wire type. The current unit appears to be made with no stock permanently attached, but with the capability to switch out between fixed, AR & wire type.

I have a fixed type outside tube laying around unused - just the outside shell. Kept it when I switched to a wire stock version, basically slide the guts of the unit from the fixed tube into the wire stock one. I was going to call Mech Tech Monday (closed Fri) & ask them to sell me the guts only of another 1911 unit - figured I'd save $100.00 or so by not needing the whole thing. Then I'd lop off the fixed stock on my existing tube, drop in the new internals & mount a handgun scope.

If the unit alone must have never had a stock on it, I suppose I'm stuck buying a new one entirely.

As an aside, I can not begin to contemplate what sort of explaining I'd have to do if the police happened across this thing (semi with no shoulder stock) on my way to or from the range, convince them it's legal without a maglock. It's over 26", so it's not a handgun. It's never had a stock on it, so it's not a rifle. It's a .........? I think I'd keep a maglock on the thing, even if it's not required I guess.

might be some grey area involved with that . Technically even if the unit had a shoulder stock, until it was attached to the frame, it may not trigger "rifle" status.

That is the type of question that you would need to write to ATF's Tech Branch for a definitive ruling on. Normally that is not a good idea to re-ask a question that has already been aked/answered by tech branch, because they can and do sometimes change their minds.

Basically most of the AOW stuff is a grey area since AOW deals in stuff that does not readily fit the "normal" catagories. If the firearm is "concealable" and is not a handgun (ATF considers handguns with multiple grips to no longer meet the definition of a handgun), then it would be an AOW.

Unfortunately there aren't a lot of absolutes in this area.

You guys are getting ahead of yourselves worrying about the stock. That doesn't matter (although it's an interesting point to debate/clarify). The MechTech unit has a barrel shroud, which is a no-go on a pistol. Stock issue aside, this is not CA legal.

but the question is, Is it a pistol if it is over 16" barrel and 26" OAL? There is some wiggle room in the definition that does leaves that question open. If it is still a pistol, then we just go fixed mag and we can have that barrel shroud legally.

Fixed mag exempt us from pistol AW and rifle AW evil feature regs. I think the reason behind the OP's question is "could there be a configuration in which the AW does not apply, even though it has a detachable magazine?"
