I spoke with CA BATFE. They said the former. They also said that if the gun is already here, it's too much of a hassle to ship it back. Just fill out the CFARS form. But that is not the right way to do it.

Think what the CA BATFE says is technically correct, but the intention to gift must occur after the gun is already present in California. 18 U.S.C 922(a)(5) and 922(d); 27 CFR 478.30, 478.32.

Bringing the guns into CA, and only afterwards forming the intention to gift them via intrafamilial transfer might be one exception to the complicated mess of inter-state intrafamilial gifts.

This is a bit confusing.

The Bureau of Alcohol, Tobacco, Firearms and Explosives is a Federal agency.
