Second Opinion(s) Needed

Hi all - need your collective wisdom on conflicting advice received from 3 different SoCal FFL’s today.

My father resides out of state and wants to gift me 3 off roster pistols. I am naturally eager to take possession of said pistols and begin depleting my already lean 9mm supply.

FFL #1 said “just drive or fly them back here with you, and register them on CFARS.”

FFL #2 said “Dad’s local FFL must ship to us, 1 in 30 applies, and we charge $75 per, plus background checks each time, and we won’t do it because it’s too difficult to get people in and out of the store during Covid.” ��

FFL #3 said “just fly back here with them, register yourself on CFARS, I just did this myself last month with off roster handguns.” Edit: #3 is the most reputable shop and has been my go to in the past. Everyone I know in the greater LA vicinity is familiar with them.

So. I would love for #1 and #3 to be correct. I’ve read conflicting guidance here and on other forums. Does anyone here have personal experience with this question? I would appreciate your informed guidance so that I can stop obsessing and get busy taking down some targets.

Find FFL#4 who can do an FFL to FFL interafamilia (spelling?) transfer and doesn't charge out the nose. Not sure about the 1 in 30 if that applies here even within LA city limits.

Pretty sure... 99%... out of state parent gift you need to go thru ffl. in state parent gift you could cfars

And no need for dad to use FFL to send them. As long as receiving FFL will accept directly from him there is no need for him to use an FFL on his end. Someone will be along soon to sum all of this up and clarify.

This is an interstate intrafamilial transfer. Since your father resides out of state, he will have to ship it to a CA FFL who will then transfer it to you using the mentioned transfer process.

This is not an 'opinion' item, this is Federal Law.

Interstate transfer of a handgun must go through an FFL in the state of residence of the receiver.

FFLs 1 and 3 were wrong; that advice gets you and your dad a Federal felony.

FFL 2 is just partly correct, as well as obviously unwilling to do the transfer.

Tell us where you are located, and probably someone can suggest a better FFL.

Thank you all for the quick replies. Will go the FFL route - now just need to find a good option. I'm located in Woodland Hills, CA, just outside of LA, so LA and Ventura counties are convenient. Appreciate any recommendations. I don't like naming names, but doubt anyone will mind if I out Turner's as FFL #2 that wasn't too helpful.

While not required by law, some FFL’s will require that the gun has been shipped to them from your fathers FFL.

Also, try to find an FFL that will release on undetermined.

Make sure Dad sends a legible copy of his DL or state ID card. Front side only is fine.

I was in the same situation twice recently. The answer is the guns have to come into state to a CA FFL. They do NOT have to come FROM an FFL. Go to shipmygun.com and sign up. They will send you a box to ship. Sign up online through them with an FFL, have it shipped to the CA FFL. You do NOT need to send FROM an FFL, you need to send TO an FFL. Ship it to the FFL and have them process it.

Your father cannot bring it in state and have you fill out the CFARS form. Well he CAN but that is not the proper way to do it.

I spoke with CA BATFE. They said the former. They also said that if the gun is already here, it's too much of a hassle to ship it back. Just fill out the CFARS form. But that is not the right way to do it.

Probably true. However the wording in the statute is at least ambiguous enough that I could not find an FFL to process 2 at the same time. I was subject to the 1 in 30. I spoke with several FFL's. None would process outside 1 in 30. The phrasing of the statute is ambiguous enough that they don't want to screw around.

The right answer is: shipmygun with however many you are shipping, then 1-in-30 because you won't find an FFL to process them all otherwise.

I just did the same. Call Nabil at Angeles Armory. It is a bit of a drive (not so bad from Woodland Hills - that's where I am), but he's open Sundays. I also used RKBA LA in Burbank. He's a great guy too. His weekday hours are better but he's not open Sunday which is what I needed. I recently used both. Both are great.
