    What am I missing?!

    I exchanged email's with an out of state dealer, which will go unnamed, about CA compliant handgun availability. I mentioned to him I really wanted a G43, but told him PPT was the only way I could procure one out here. I mentioned I was not LEO, but he said he ships off-rosters into CA a lot.

    Again, I made it clear this was for non LEO. But he insisted that he ships out off-rosters into CA often. They obviously have to have a CA FFL willing to accept it, right?

    So what am I missing? Please help me understand. TIA.

    They’re probably unfamiliar with CA exempt and transfers.

    No reputable CA FFL will transfer it to you and will be shipped back.

    Maybe he makes some money on restocking fees?

    Why not out the FFL as it’d be one people would avoid for not being aware of the roster etc. especially in a time like this with the flood of new gun owners.

        He never mentioned a restocking fee, but I'm sure it's in the small print.

        No, I specifically asked him this is for NON LEO. I asked who he was shipping to, wouldn't say.

            I don't know anything about glocks so... If the G43 is not on the roster, then you know you can't have it shipped; why are you wasting their time? If it's on the roster, then there is no need for this post all together. If you're trying to fish for a way to get around the roster, then a public post isn't going to help you.

                I had a similar situation with a guy selling a Taurus on armslist last week. He kept wanting to get my address to ship directly to my house, and insisting that I wasn't serious about wanting it when I was trying to explain to him that it was illegal. My guess is people out of state just can't believe the ridiculous laws here.

                  You're going to end up paying a restocking fee. It is not up to the shipper, it is up to your receiving FFL.

                      Exactly what I was trying to explain to him. Even though the listing was in CA, and he said he'd be shipping from Alameda (with a Texas area code), I told him that off roster deals can't be shipped, and had to be done at the FFL, but he kept insisting for my address.

                        I got in touch with him because he posted about shipping an off-roster in a CAL based forum. So I inquired, just in case I was missing something.

                          OOS dealers willing to ship to CA is a good thing. OOS dealers though don't always understand our laws. It sounds like they are just a little bit confused.

                          They can and as they said ship off roster guns to CA all the time. They could be going to someone who is roster exempt. It could be an off roster revolver that is going to be converted to SAO. It could be that someone who didn't know the laws in CA ordered it.

                          It's in the last case that is the worst. Someone in CA who is not roster exempt can order an off roster gun and have it shipped to a CA dealer. Once it gets to the CA dealer and the dealer finds out that the buyer is not roster exempt the CA will NOT be able to transfer the gun to them.

                          What happens now? Well any number of things can happen. The dealer can send it back to where it came from, for a fee. The company who sold it to the buyer will probably want a restocking fee. (Gun= $1000, less $100 to send it back less 25% restocking fee $250, CA buyer loses $350) Maybe the CA dealer will offer to buy it from the CA resident for a price that would be more than his charge to ship it back and what the OOS dealer's restocking fee is. (CA dealer offers to buy gun for $750, CA buyer loses $250)

                          Best case is CA dealer offers to put it on consignment to roster exempt people only and charges you 20%, you only lose $200.

                          Moral of the story: If YOU know it's off roster and YOU know that a CA FFL CAN NOT deliver it to you, DON"T buy it regardless of what the OOS dealer is telling you.
                          Yes you can have 2 C&R 03 FFL's; 1 in California and 1 in a different state.

                            Does the dealer mentioned sell C&R handguns to California? Those would be off-roster but are exempt from roster requirement.

                              This my understanding, so someone please correct me if I am wrong.... the OOS dealer couldn't care less if the pistol is on-roster or not. Most OOS FFLs will pay attention to Roster because it is a waste of their time and resources to ship a pistol to CA only to have it come back, etc. I am not an FFL but I'm sure there's also some paperwork involved in the transfer of a pistol from one FFL to another FFL. At the end of the day, if your local FFL is willing to accept the pistol, then the OOS FFL gets paid and is a happy camper. Now the problem for you, the buyer, is that your local FFL will not be able to transfer the pistol to you (even though you've already paid for the pistol). So now the pistol will just sit in your local FFLs inventory until he can legally transfer/sell it to someone either in the state of out of state.
