    Non-Roster Question

    Hi everyone. I'm new here and I already have a question!

    I live in California and I have a friend who lives in Washington state who recently purchased a handgun that he's looking to sell. I'm interesting in buying it from him, but the problem is it isn't on the CA approved Roster, it's a variation of a gun on there though.

    So the question is, would it be legal for him to mail it to an FFL in CA for me to purchase? Or can I only purchase a gun like this in a face-to-face PPT (private party transfer) at an FFL?

    I would greatly appreciate any insight on the topic. Thanks!

    No, if it isn't rostered, you can't receive it from your friend. Can't be mailed to your FFL, and can't be PPT'ed through an FFL either.

    What firearm are we talking about, to make sure it isn't rostered.

        Thanks for the quick response! It's a Wilson Tactical Super Grade. Also, in 3 months he is moving back to CA. If he can file to have the gun imported, could he sell it to me as two california residents doing a PPT?

        If not, maybe I'll trade places with him in Washington. Thanks again.

          Nothing wrong with him PPTing it to you after moving here.

          This has been covered elsewhere, but someone here was exploring the idea of an in state PPT where the seller is not a resident of CA. I think it's outcome hinged on the need to use CA DLs or IDs on our DROS process.

          Even though, the letter of the law does not specify that the seller needs to be from CA.

          Anyone remember if there was fed issue with this? Was the original scenario;
          A long term visitor to CA (coming out for work) bringing a handgun with him.
          Then needing to sell it to finance his return home (job ending suddenly).

            edit: thats right, you said a variation of it, different color?

            If not, when he moves back to CA, within 60-days, he would need to register the handgun OR sell it to you in a PPT transfer once he has his CA DL.

                Looks to be an underground regulation. Hopefully CGF will be able to make some headway in the near future.

                  It appears that nothing legally prevents an out of stater while in CA, from, PPTing a non-Rostered handgun to a Californian. The only limitation is the DROS system requiring CA ID.

                  We thought this was a just a screwup - "law added by accidental software restrction" - but it appears intentional from DROS documentation that Librarian found.

                  Senior CA NRA staff assert there is nothing legally preventing this from happening, and we're running with the ball.

                        Great topic. I thought you could actually PPT a handgun from someone out of state as long as they were here in California to do the PPT. I could be in the same situation then where my friend was going to sell me his HK P30L when he came out on business but after reading this it doesn't appear that is an option cause he doesn't have a CA DL. BUMMER!!!

                          Now, does it have to be the permanent (plastic) Driver's License? Or, will the temporary (paper copy) when attached to another form of ID (out-of-state DL from the state when just moved from) be enough for a PPT?

                            I don't think that would work because I know when I got a new license after moving I had to surrender my previous states license.
