Full disclosure. I am one of the plaintiffs for CPRA/Michel & Associates. I have been for months. I don't think ACSO really gives two craps. I have reached out to Judea requesting an update on scheduling a date to pick up my permit last week, but did not receive a reply back. I submitted all of my completed training and qual to her on 3/13. I was considering reminding her that ACSO is violating CA PC 26205 by not following these guidelines in plain text.. in the most respectful way I can.

Mannn I know I am in the 150’s I was interviewed by a a lady that was about to give birth. So I feel that whatever ccw cases she had got thrown in the back pile smh.. I read someone here in in the 1000’s, good luck to all of us but they are going to take years at this point to get to that, at this paceComment

My understanding is CRPA will not be filing at this point as they received a response a while ago from the county stating that they would be making some changes to expedite the process, hire more staff and get rid of some of the requirements that they had those of us go through who went before you. Maybe CRPA will revisit the possibility if all ACSO is doing is blowing smoke, but I really think many here missed the ball when CRPA announced in this thread that they were asking for litigants. I know for a while well before that request for litigants I was the ONLY one and was amazed at how many were complaining in this thread, but nobody was stepping up and acting on it, essentially hoping others would do it for them. Also, I recall several people here mocking those of us who applied right away telling us we were guinea pigs and were wasting our time and money and that they weren't going to fall for it and would instead sit back and wait for the dust to clear once the process becomes easier, essentially letting those of us who were proactive and willing to jump through the hoops do the heavy lifting so to speak.
My question to you guys is where were you months ago when CRPA was asking for litigants? Many wouldn't step forward then and even before. Now that you aren't being issued in a timely manner you're complaining, when earlier it was time to step up and take action. It's a little late now.
When I picked up my permit several weeks ago I was told they currently had over 2,000 applicants. FWIW, I was also interviewed by the same pregnant woman last year.Mannn I know I am in the 150’s I was interviewed by a a lady that was about to give birth. Where was I? Excuse me but don?t judge when you don?t know. I reached out to CRPA and FPC early on and only FPC got back to me and questioned me about my background to be a plaintiff. I did the same. I reached out to both once my 90 days after submitting my application had come and gone and was contacted by both almost immediately I turned down FPC because they didn?t rub me the right way and if were being honest, seemed like a bunch of unprofessional hacks.Where was I? Like I said, for quite a while I was the only litigant on the CRPA potential lawsuit. A couple others bailed leaving only myself. I was also questioned about my background and deemed an exceptional potential plaintiff by both organizations.Last edited by Vinnie Boombatz; 04-07-2023, 10:10 AM.sigpicComment

I'm at the point where I am done caring. I've already gone through every step, including passing the qualification at the ACSO range. They have also cashed both of my checks so I have completed every step and paid every associated fee. After 30 days are up I plan to carry. The Sheriff is in violation of PC 26205. Concealed is concealed and if I do get caught it seems like a solid affirmative defense case but I will consult with my attorney first.I did the same. I'm not suggesting anyone should carry without attempting to go through the state's requirements for obtain a permit. The Courts concurring opinion in Bruen stated that shall-issue permitting in permitted as long as the process is objective and in effect "shall-issue" to qualified individuals.
My situation is vastly different. I have gone through all of the steps in the process that the IA has laid out. The IA is not following State law, let alone the Bruen decision. My argument has nothing to do with Bruen. My compliant is that the IA is not following state law, the same law they hold us all to.Comment

We haven't ruled out anything, for the record. But Alameda's new sheriff was very responsive to our concerns, and eliminated some of the most ridiculous requirements immediately after we contacted her. Processing times remain a HUGE concern for us, and the county has agreed to continue providing monthly updates. In fact I should be getting one soon and will share it here when I do.My understanding is CRPA will not be filing at this point as they received a response a while ago from the county stating that they would be making some changes to expedite the process, hire more staff and get rid of some of the requirements that they had those of us go through who went before you. I also talk to county counsel all the time about individuals facing various issues, as some on here can probably confirm. Just this week I was helping someone out who was being asked to provide DROS paperwork for a gun they owned, which he no longer had.
I'd love to sue everyone. But given CRPA's limited funds (we don't have a Michael Bloomberg funding us) and competing litigation priorities, if a county is working with us in good faith, then a lawsuit is less likely. As long as Alameda continues to work with us to improve the situation, then we can give them some rope. Remember, this is a county that almost never issued to anyone pre-Bruen, and now we are regularly seeing people approved for carry permits.
Our patience is not endless of course. Wait times cannot continue to be this long deep into the future even after they've had a grace period to get caught up, or we will have no choice but to sue.sigpicComment

The letter from the county counsel office was a nice first step but it hasn't translated into real action with regards to their failure to timely process applications, timely notify applications of each step, and timely issue permits. We haven't ruled out anything, for the record. Without you and CRPA we wouldn't be where we are to be sure and I greatly appreciate all of your efforts but it's starting to look like the letter was just to buy time until SB2 gets passed and signed into law.Comment

You?re no different than anyone else here who is in the process or has already received their permit. What makes you so special?!I'm not suggesting anyone should carry without attempting to go through the state's requirements for obtain a permit. Also interesting that FPC interviewed you and didn?t offer you a spot as a plaintiff and CRPA never got back to you while they were more than welcoming to others. Makes me wonder about your credibility.sigpicComment

I wouldn't take our non-response as any kind of reflection on the individual. We have been swamped with work lately post-Bruen, and some days we are busier than others and just can't respond to everyone. You?re no different than anyone else here who is in the process or has already received their permit. It's a frustrating set of circumstances but I try to keep perspective on how things were a year ago vs. now.
As for SB2, that is one I can definitively say we will file on day 1 if it passes. That complaint is already drafted because we were ready to go for SB918. We are currently set to challenge all the "sensitive places", but may expand it to also challenge the new permit issuance laws as well.sigpicComment
