    Question regarding buying firearms online and sending to FFL dealer.

    How's it going Riflegear.

    Just a few simple questions regarding purchasing firearms online.

    I've recently came across a firearm that I'm really interested in on Gunbroker.com. I was wondering what are the appropriate steps to having a firearm that is purchased off of gunbroker.com to be sent to you guys for myself to pick up and start DROS etc.

    I have never bought a firearm online before, any answer regarding steps, required paper work, how I would go about giving your shipping information to the dealer that I'm purchasing the firearm from on Gunbroker.com, etc.

    I have not purchased the firearm yet, but very eager to.

    If they are a licensed dealer, they will want a copy of our FFL which they can obtain by emailing sales@riflegear.com.
    They will then ship the package to us. We require an invoice be included OR provided by you so that we can calculate sales tax as per CA BOE regulation.
    You must then come in person to start paperwork and pay sales tax, the state $25 DROS fee, and our $75 transfer fee for facilitating the transfer.
    Bring all the same required documents you normally use (plus a copy of the invoice if the vendor did not include one with your firearm).
    Then the ten day wait begins.

    If it is a private seller and not a licensed dealer, then no invoice is required as we don't have to collect sales tax. We just request that a photocopy of the seller's state ID/DL be included in the packaging with the firearm.
    All transfer fees still apply.

        Is this still true?

        I just went into an East Bay dealer to start a transfer on a lower I purchased out of state. And I was asked how much I paid for it so that I could be charged tax on it.

        I was surprised that I was going to be charged for a lower I bought from a person from another forum. No dealer, no reseller, no FFL.
        When I said it was free, a gift. The dealer said he would check online and charge me what it was worth.
        I was like how can I be charged for a used part at full retail from a non reseller??

        But since the lower is due to arrive any day, I paid the fee and will be asking the seller to send me a receipt for it so I can pay tax on it, that I thought I wasn't supposed to pay.

        Can anyone clarify this?

          If the lower is truly from a private party, a non-dealer, no sales tax is to be collected. It is considered an "occasional sale" and is not subject to sales or use tax. However, if you first told them you bought it from a private party, and then changed the story and said it was a gift instead, they probably don't believe you at this point anyway. If the story keeps changing they are going to assume you are just trying to weasle out of paying the sales tax. You should produce some documentation that they can keep on file that proves no CA sales tax is due. Are you 100% sure the person you bought it from is not an FFL and didn't send them a copy of their FFL along with the shipment?

            Before I even had the lower shipped I had email correspondence with someone that worked there. Yes this person is not a retailer. He is a member on several forums and that's how I purchased the lower.

            What happened is when I went to start the transfer after getting confirmation it was sent. The person doing the transfer doing asked how much I paid for it. I asked why he wanted to know and he said it was to charge tax. After some talking to him and telling him it is a private party transfer he said it wasn't because the seller is not here. He even showed me a letter from boe. But after reading that letter it clearly says retailer to ffl. I brought that up and it began a back and forth.
            He kept asking me so I said it was free. So no tax. He threaten to look it u online and charge me tax on retail price on the used item. I didn't want to argue so I told him I will get the seller to email me a receipt with all his info and the price I paid for it.
            I paid the fee of 100 for the transfer and my receipt says sales tax to be determined.
