    FFL Holder SSE question

    As an FFL I'm new to the SSE stuff and I'm trying to get info before I run out of time. I have an off roster S&W 39-2 that I bought from out of state. I don't do SSE conversions so do I have to sell it to someone out of state only now? I have another firearm that I bought out of state andI had it DROS'd in my name with an SSE through a local shop. Do I have to hold on to it for a certain period of time before I can sell it?

    You can sell it to someone who is exempt, such as a LEO, or sell it out of state.

    With respect to the handgun that you transferred to yourself, if you did not fill out a 4473 (sole proprietor), then you have to run it through your book unless you have had it over one year. If you filled out a 4473, then you can sell it just like anyone else.

      Kemasa, so I'm clear on avoiding 1 year hold…….If no 4473 done when transferred to self-sole proprietor, and I state "transfer to personal collection" instead of Form 4473 serial number in book, then all I need to do is log it back in from me personally, then out to new buyer with a 4473?

        Yes, that is correct. You can also ship it to another FFL, but the main thing is that you have to run it through your book. The reason for this is that in free states you could just do a cash and carry, so the BATF does not want FFLs transferring firearms to themselves and just selling them. Since CA requires the transfer to go through a FFL, it does not really matter as much, but it is still the Federal law.
