    Question for FFL's...

Hi, I am really having a problem and hope one of you could help me though this. I purchased a gun online and had the transfer done at an FFL I had never been to. After 5 days of my waiter period had past (today) I got an email from them saying it was denied. This makes no sense to me as I have bought many guns before, even a few months ago and never had a problem. I have a completely clean record, not even a traffic ticket. I called the FFL asking what to do and he wouldn't answer any questions as to what I was supposed to do and ended up yelling at because I asked him if he could re-run the DROS. I've researched it online and I know I have 30 days to do some power of attorney thing but I am completely lost. I am going to get it sorted out as soon as I get the letter stating the reason why but what do I do with the power of attorney papers? Does my FFL keep the gun? And if I do sign it over to someone else for 30 days, are they able to pick it up somewhere?

I really appreciate any help you guys can give me, I spent a lot of money on this gun and am worried I am going to mess something up and lose it all somehow.

Nothing your FFL can do if you were denied, it is not his decision.

Your FFL will keep the gun, our policy when someone is denied that we will not sell or transfer the gun to anyone that the denied person knows.

Did you check your DROS paperwork? Everything entered correctly? Drivers license expired? Was it SSE? Did dealer enter it correctly?

I realize the FFL has nothing to do with the denial I was just hoping he would tell me my options. I looked over my copy of the DROS and everything was accurate, ID is not expired but yes it was an SSE. Do you think that has something to do with it?

Have you bought any handguns or other SSE in the past 30 days? That will also get a denial.

No, I purchased a Glock 2 months ago and that was the last one.

What is really confusing me is that if I had bought a gun from his store and was denied, he could just refund my card and I wouldn't be worried about loosing my money but because this was an online order, I have accepted the transfer (which I think means it is in my name) but cant legally own the gun. Thats were these attorney papers come in and I'm not a lawyer so I have no idea what any of it means or what I'm supposed to do.

The gun is not in your name until the FFL hits the DELIVER button on the DES system after 10 days.

Right now the gun is in limbo, you can't DROS it and your FFL now have to store it. Chances are you'll be out the cost of the gun, DROS, transfer and SSE fee.

You need to contact the online shop you bought the gun from and tell them you were denied. Hopefully they will agree to take the gun back. You will get dinged with a restocking fee and shipping fees. If they agree they can send a call tag to the FFL who is holding the gun right now.

                  1. You need to be more specific as to what type of "gun" we're talking about.

                  2. I'm not clear:
Who denied you? Your FFL: can't deny you unless either a completed DROS was submitted and DOJ denied you...or...unless the gun was not approved for CA!!

You have the right to contact DOJ to inquire as to a denial (if in fact they denied you) and your FFL should have supplied you with DOJ contact information upon your request. Obviously, your FFL can't answer questions which need to be posed to DOJ.

I really hope I'm not out, that was a lot of money.

I checked and it says no returns unless defective.

The gun was a CA legal SSE pistol. The DOJ denied it but I have a perfect record, valid drivers license, and no reason at all to be denied. I believe it was a mistaken identity or some other error on their (the DOJ) end. What I'm worried about is by the time I get through the appeal process and get approved, the FFL wont keep my gun for that long. I don't know if they can legally sell it or something in which case I would loose everything.

There is a number which you can try to call the CA DOJ to find out the reason. Depending on what the reason is, that determines the next step.

You would not need a power of attorney for this firearm since it was not transferred. You need to discuss with the FFL what you want to do since they can charge storage/shipping.

Not an ffl but what is a "ca legal sse pistol"? Is it on the roster or is it SSE (single shot exempt)?

is there a chance the FFL did not input dros properly for SSE???

My assumption it was a gun shipped in SSE configuration

Given the date (late December) and if the gun will not qualify as a roster exempt transfer next year, I would see if the dealer will allow you to sell it on Calguns and let the new person take over.

It is possible it was a case of mistaken identity, but the DOJ can take a while to get back to you and if you are not able to DROS the gun in 2015, I would try to sell it and cut your loses now.

Maybe have the new person sign a document that says they did not know you before, etc so the FFL has some evidence it was not a straw purchase. Or only sell to someone in a different part of the state so it has to be shipped (more evidence of not a straw purchase)

Again, you will need to speak with your FFL. Maybe in person is better.

I would start a two pronged attack. Try to get it resolved with the DOJ, but also assume it will not be resolved by Jan 1, so have a plan B in place.
